In the article, public-private partnership (hereinafter - PPP) is analyzed as one of the ways to implement infrastructure projects. This form of cooperation arises primarily in those areas for which the state bears responsibility (for ex-ample, road construction, housing and communal services, healthcare, con-struction of social infrastructure facilities, etc.). Due to the strategic importance of the above spheres of the economy, the state can not completely abandon control over their functioning. At the same time, there is a need to maintain the operability of the objects included in them, as well as to attract additional (in addition to budget) funding. Based on foreign experience, the most optimal form of cooperation in this case is PPP.
The article is devoted to the research of municipal-legal problems of increasing the efficiency of civil society functioning in Ukraine. The emphasis is on the need to improve and strengthen the legal status of local self-government as the fundamental institution of civil society. The contemporary theory of local self-government as an institution of civil society is considered, its role in ensuring the stability of the constitutional system and the development of constitutionalism in Ukraine is determined. The basic theories of self-government are analyzed, the definition of local self-government as one of the main forms of democracy and the constitutional means of limiting state power in the conditions of formation of civil society is proposed. This approach emphasizes the increasing role of the municipal-territorial factor in the life of civil society. It is connected with the creation of capable territorial communities, confirmation of democratic intentions of national states and their special attention to the inhabitants of certain territories. It is concluded that only realization for long time in the minds of residents - members of territorial communities - of stable anti-theatrical institutions, radical changes in the stereotypes of socio-political behavior of the general population, its self-organization and self-discipline, the formation of patriotic sentiments may in the future become the basis for leveling the conflict between state and public interest, the formation of an optimal balance between public and private, and, therefore, a powerful tool for improving efficiency the organization and functioning of civil society.
Aim. The article aims to investigate the essential and content characteristics of unitarism as a phenomenon of contemporary constitutional law. The synergistic connection between the doctrine of modern unitarism, the principles of unitarity of the state territory and the fundamental institutions of political-legal and state-administrative life of modern unitary states is shown. It proves that the unitary system is not only one of the important components of the process of accomplishing the tasks, goals and functions of most modern states, but also an immanent feature and strategic element of the mechanism of exercising their sovereign rights. Methods. The methodological basis encompasses philosophico-ideological, general scientific principles and approaches and special scientific methods of inquiry for constitutional and legal phenomena and processes. The philosophico-ideological basis of the study is the position of dialectics, on the basis of which the causes and factors of the evolution of unitarism are thoroughly investigated. In general, the research was conducted on the basis of a combination of ontological, epistemological and axiological analysis of contemporary unitarism. Results. The complexity, importance and relatively widespread use of unitarity as a form of government is causing a lively and ever-growing scientific interest in it throughout the world. The unique capability of unitarism to take into account the specific features of a particular condition allows it to manifest itself in each case in a new way. That is why it is important to analyze the mutual influence of unitary theory and practice, to explore and take into account the peculiarities of national unitarism. The problem of unitarism and the unitary form of the territorial structure of the state and the status of its constituents is one of the least studied in domestic constitutional law. Modern scholars studying constitutional law, as a rule, are limited to consideration of individual issues of the territory, in particular, the features of the territorial organization of state power and local self-government, problems of state sovereignty, territorial integrity and inviolability, etc. To a large extent, the problem has not been studied exhaustively in contemporary Ukraine which causes difficulties in understanding such interrelated but not identical phenomena as unitarism and unitarity, regionalism and regionalization, municipalism and municipalization, decentralization and deconcentration, etc. It should be noted that in modern literature related to problems of state territory, territorial organization of state power, and other issues of the status of territory, the complex, multidimensional nature of unitarism, as a constitutional category, is not always taken into account. Conclusions. Unitarism is proved to be a multidimensional socio-political and constitutional phenomenon: it is an idea, a theory, a scientific direction as well as a global social constitutional practice and a constitutional form of the existence and functioning of territorial communities, it is the historical condition of national statehood and Ukrainian regional civilization and the form of realization of the national identity and civic consciousness, etc.
The purpose of the article is a constitutional and legal study of the essential and substantive characteristics of federalism as aphenomenon of modern constitutional law. The synergistic relationship between the doctrine of modern federalism, the principles of federalism of the state territory and the fundamental institutions of the political, legal and state administration life of modern federalstates is shown. It is proved that the federal state structure is not only one of the important components of the process of achieving thetasks, goals and functions of modern federal states, but also an immanent feature and a strategic element of the mechanism for theimplementation of their sovereign rights.A critical analysis of topical problems of the theory and practice of modern federalism is given. It is proved that federalism is amultidimensional socio-political and constitutional phenomenon: it is an idea, and an independent theory and scientific direction, andglobal social and constitutional practice, and the constitutional form of existence and functioning of territorial collectives and regions, and the historical state of statehood, and a form of implementation. national identity and citizenship and the like.It turns out that the constitutional establishment of a federation does not in itself provide society with the right to free choice anddemocratic institutions. Moreover, federalism itself needs democratic principles. In other words, the less democracy there is in a statethat builds federalism, the less chance there is to build it, and therefore the more conflicts and clashes. The experience of the formation, existence and disintegration of these federations shows that the legal design of a federal state does not always take into account thepresence / absence of preconditions for federalism, that the application (political and legal) is more federal than federalism, that is, itsform, not its content. Therefore, in order to form a federal system in transit countries with adequate political infrastructure, it isnecessary not only to develop and adopt at the national level a program of federal construction, but also to ensure the conditions for itsimplementation.
