In the article, public-private partnership (hereinafter - PPP) is analyzed as one of the ways to implement infrastructure projects. This form of cooperation arises primarily in those areas for which the state bears responsibility (for ex-ample, road construction, housing and communal services, healthcare, con-struction of social infrastructure facilities, etc.). Due to the strategic importance of the above spheres of the economy, the state can not completely abandon control over their functioning. At the same time, there is a need to maintain the operability of the objects included in them, as well as to attract additional (in addition to budget) funding. Based on foreign experience, the most optimal form of cooperation in this case is PPP.
У статті досліджуються питання доктрини муніципального права як галузі права. Розглядаються різні підходи до муніципального права в аспекті теоретико-методологічного розуміння вчення про муніципалізм, муніципальні права людини та муніципальну владу. Така постановка питання обумовлюється тим, що питання предмета і методу муніципального права, його місця та ролі у системі права, природи, принципів, функцій відносяться до найбільш дискусійних у сучасній юридичній науці. Метою статті є поглиблення доктринальних засад муніципального права як самостійної галузі права. Отримати найпродуктивніші результати та зробити найоптимальніші висновки щодо проблем муніципального права у межах загальної теорії права та муніципально-правової науки можна тільки за умови використання комплексного концептуально-муніципального підходу, розглядаючи, наприклад, становлення і розвиток муніципального права у межах еволюційного процесу розвитку місцевого самоврядування та муніципалізму. За такого методологічного підходу феномен муніципального права необхідно розглядати не тільки у контексті його концептуальної та нормативно-правової моделі, а й як прояв об’єктивної реальності, яка має не лише нормативні та функціонально-телеологічні характеристики як частини національного законодавства, а й аксіологічні, гносеологічні, онтологічні, цивілізаційні, інституціональні, суб’єктно-об’єктні, конститутивні, історичні, категоріальні, ідеологічні, економічні, ментальні параметри, які еволюційним шляхом сформувалися під впливом відповідних ідей та принципів. Стверджується, що муніципальне право як галузь права є продуктом теорії муніципалізму та багатовікової практики місцевого самоврядування, результатом розвитку його концепцій і моделей під впливом принципів та ключових ідей демократії, правовладдя і прав людини. Це своєрідна та унікальна нормативно-правова модель стану розвитку місцевого самоврядування у певній країні або світі загалом. З огляду на це муніципальне право слід розглядати не лише з позиції визнання місцевого самоврядування державою, а й у синергетичному зв’язку з формуванням муніципальної правосвідомості та муніципальної культури, процесами реалізації муніципальних прав людини, вихованням почуття належності до територіальної громади, у загальному контексті розвитку конституціоналізму тощо. У статті доводиться, що муніципальне право притаманне виключно конституційній державі, в якій не лише визнаються, проголошуються, а й реально діють принципи правовладдя, людиноцентризму, поділу влади, субсидіарності та децентралізації тощо. Робиться висновок про самостійний галузевий характер муніципального права, свідченням чого є наявність притаманного тільки йому предмета правового регулювання, специфічних правових конструкцій і категорій, своєрідної структурованості норм та інститутів, поєднання різних методів юридичного впливу. Тобто йдеться про сукупність факторів внутрішнього характеру. Розглядаються і зовнішні системоутворюючі фактори, які забезпечують муніципальному праву статус самостійної галузі права, зокрема особливості суспільно-політичного розвитку, конституційні перетворення та економічні реформи, вплив природного права, національних, історичних, духовно-культурних та інших традицій, рецепція міжнародних стандартів тощо.
The article is devoted to the research of municipal-legal problems of increasing the efficiency of civil society functioning in Ukraine. The emphasis is on the need to improve and strengthen the legal status of local self-government as the fundamental institution of civil society. The contemporary theory of local self-government as an institution of civil society is considered, its role in ensuring the stability of the constitutional system and the development of constitutionalism in Ukraine is determined. The basic theories of self-government are analyzed, the definition of local self-government as one of the main forms of democracy and the constitutional means of limiting state power in the conditions of formation of civil society is proposed. This approach emphasizes the increasing role of the municipal-territorial factor in the life of civil society. It is connected with the creation of capable territorial communities, confirmation of democratic intentions of national states and their special attention to the inhabitants of certain territories.It is concluded that only realization for long time in the minds of residents - members of territorial communities - of stable anti-theatrical institutions, radical changes in the stereotypes of socio-political behavior of the general population, its self-organization and self-discipline, the formation of patriotic sentiments may in the future become the basis for leveling the conflict between state and public interest, the formation of an optimal balance between public and private, and, therefore, a powerful tool for improving efficiency the organization and functioning of civil society.
