In the article, public-private partnership (hereinafter - PPP) is analyzed as one of the ways to implement infrastructure projects. This form of cooperation arises primarily in those areas for which the state bears responsibility (for ex-ample, road construction, housing and communal services, healthcare, con-struction of social infrastructure facilities, etc.). Due to the strategic importance of the above spheres of the economy, the state can not completely abandon control over their functioning. At the same time, there is a need to maintain the operability of the objects included in them, as well as to attract additional (in addition to budget) funding. Based on foreign experience, the most optimal form of cooperation in this case is PPP.
The article is focused on research of the globalization process at the modern stage of overall global social development. It is becoming a firmly established fact that globalisation as an objective and inevitable process of any country determines the orientation of Ukraine on integration with the international community and inclusion in the processes of planetary scale in all functioning spheres of the society. Based on the analysis and synthesis of different approaches to understanding globalization and its consequences, it is concluded that globalization is a complex, internally contradictory process of interaction and interdependence of various participants in international relations (states, international organizations, multinational companies, other participants) across all major directions of their functional activities. Contradictions between national and supra-national interests produce interstate conflicts, require strengthening of the protective function of law and state.

VM Koretsky National Academy of Sciences of Ukraine; Academy of Labor, Social Relations and Tourism, Kyiv, UkraineSome conceptual problems of the development and adoption of Kyiv territorial community's charter, its place and role in the system of local normative acts of the city have been considered in the article taking into consideration the domestic and foreign experience of formation and development of the municipal statutory law. The criteria, which statutes of territorial communities should correspond to, have been defined, their functions have been determined. The institutional and functional factors of the modernization of the existing municipal administration system in Kyiv have been formulated and the preconditions for the development and adoption of a new version of Kyiv territorial community's chapter, which would use the practice of the current version's use have been studied. The model of its structure has been suggested. An attempt to predict legal, political, socio-economic, psychological and other consequences of the adoption and application of the new version of Kyiv territorial community's Charter has been made.
In the article, taking into account foreign experience of development of modern systems of municipal management and practice application of the provisions of new legislation on decentralization highlights the conceptual problems of reforming local government and territorial organization of power in modern Ukraine. Describes the char-acteristics of the legal status of the territorial community as the primary subject of the municipal authorities in Ukraine and foreign countries. Analyzed the current state of the legal status of the territorial community, the basic of the modern constitutional project initiatives in part on local self-government in Ukraine from the position of the principles of classical muncipalism. We separately consider the possible risks with the possibility of introduction in Ukraine of Institute of the prefects and new mechanism of control over activity of local governments, draws attention to the shortcomings of legal support of process of formation of territorial basis of local government - the creation of local com-munities who owned the resource base necessary to ensure compliance with the tasks and powers transferred to local government during the decentralization. Proposed separateproposals to prevent possible conflicts of laws and organizational conflicts that can arise in the application of the provisions of the law of Ukraine «On Association of territorial communities».
In the search for optimal ways of improving the normative foundations and organizational-legal forms of human rights protection, the problem of institutional support of relevant processes is actualized. The protection of human rights is inherently linked to all public-power structures of the mechanism of state power and is possible only in the context of optimal implementation of the principles of the rule of law, separation of powers, democratic, social, rule of law. In Ukraine, in the context of constitutional modernization, the problem of improving the organizational-legal mechanism of human rights protection remains urgent. For this purpose, the Institute of the Ombudsman operates in Ukraine. Its implementation fully meets the tendencies existing in the modern democratic world and is a reaction to those conflicts and contradictions that exist in the field of human rights protection. Nevertheless, the social insecurity of certain sections of the population (children, pensioners, persons with disabilities, servicemen, migrants, internally displaced persons, ethnic minorities, persons belonging to the LGBTI community, entrepreneurs, patients and other categories of citizens) is an indicator of the relevance of the problem and the functioning of national human rights protection mechanisms, including the strengthening of the relevant oversight functions of the Ombudsman. The subject of the research is the problems of reception in the constitutional law of the basic models of organization of the Ombudsman Institute in the mechanism of functioning of the rule of law. The object of the study is the public relations that delve into the human rights protection process and the ombudsman's exclusivity in the relevant processes. The methodological basis of the study are general scientific methods, such as dialectical, comparative-legal, formal-legal, historical, and logical methods of cognition, as well as special and private-law methods. The history of development, the causes, the processes of institutionalization and constitution of the ombudsman services in the modern world, the permanent transformation of their functions and the differentiation of their specialization are evidence of the improvement of the classical system of separation of powers and the constitutional mechanism of its organization. It is argued that the functional isolation, independence, and organizational diversity of the control bodies, first of all, the Ombudsmen, is a testament to the formation of control power, the conceptual idea of which is the existence of a system of measures to ensure control over public authority.

The article is devoted to the conceptual problems of statutory rulemaking in local self-government. Conceptual analysis of axiological aspects of municipal statute norm-making is carried out. There is a connection with the axiology of the municipal statute law of the problem of its ontological significance. It is substantiated that the disclosure of ontological aspects of municipal statutory rulemaking will show the role of territorial communities as a special form of law in terms of the embodiment of the ideals of municipal democracy as a person, a member of a territorial community. The essential features and substantiated structural, informative and functional characteristics of the institute of statutory law in the local self-government are revealed. Attention is drawn to the coordination-integration and orientation-coordination value of the municipal statutory norm-setting. Established sources and forms of statutory law in local self-government and substantiated the basic organizational and legal patterns of its development. The system of functions of the statutory right, to which the authors include such as: legitimate, managerial, regulatory, innovative, reformatory, right of establishment, human rights, ethics are given. It is concluded that an important criterion for determining the effectiveness of the statutes of territorial communities and the system of their functions, their social value is the effectiveness of the implementation of these functions in order to fulfill the tasks and objectives laid down in the municipal statutory regulation. Municipal statutory law - nothing if its provisions are not implemented in the activities of territorial communities and their members – the inhabitants of villages, settlements and cities, in municipal-legal relations. It is impossible to understand the value, essence, content, functional and teleological purpose of municipal law, if we deviate from the mechanism of its realization in the life of a society of specific territorial communities. This statement, first of all, should be attributed to the assessment of the statutes of territorial communities, their norms and functions. In other words, the statutes of territorial communities remain completely ineffective documents, and their prescriptions – abstraction, devoid of real meaning and practical significance, in the case where, firstly, the adoption of the statutes of territorial communities did not have objective preconditions; and secondly, the statutes of territorial communities do not have a real impact on social relations in the field of local self-government. Therefore, the effectiveness of the existence and functioning of the statutes of territorial communities and their normative requirements is determined by the degree of their implementation.
The article is devoted to the research of municipal-legal problems of increasing the efficiency of civil society functioning in Ukraine. The emphasis is on the need to improve and strengthen the legal status of local self-government as the fundamental institution of civil society. The contemporary theory of local self-government as an institution of civil society is considered, its role in ensuring the stability of the constitutional system and the development of constitutionalism in Ukraine is determined. The basic theories of self-government are analyzed, the definition of local self-government as one of the main forms of democracy and the constitutional means of limiting state power in the conditions of formation of civil society is proposed. This approach emphasizes the increasing role of the municipal-territorial factor in the life of civil society. It is connected with the creation of capable territorial communities, confirmation of democratic intentions of national states and their special attention to the inhabitants of certain territories.It is concluded that only realization for long time in the minds of residents - members of territorial communities - of stable anti-theatrical institutions, radical changes in the stereotypes of socio-political behavior of the general population, its self-organization and self-discipline, the formation of patriotic sentiments may in the future become the basis for leveling the conflict between state and public interest, the formation of an optimal balance between public and private, and, therefore, a powerful tool for improving efficiency the organization and functioning of civil society.
