Resumo O artigo analisa a pertinência da elaboração de um instrumento internacional vinculante que responsabilize diretamente as empresas transnacionais pelas violações de Direitos Humanos decorrentes de suas atividades. A partir do referencial da arquitetura da impunidade e da utilização de exame documental e de revisão bibliográfica jurídico-compreensiva, analisa-se a insuficiência do atual framework composto pelos Princípios Orientadores e se evidenciam os desafios apresentados para a construção de um instrumento internacional complementar a tal conjunto normativo. Nessa perspectiva, o artigo examina os trabalhos desenvolvidos no âmbito das Nações Unidas que objetivam a regulação das transnacionais, desde a década de 1970 até o atual processo de elaboração de um tratado em Direitos Humanos e Empresas. Apontam-se, ainda, os desafios jurídicos e políticos para a elaboração de um instrumento vinculante, seu consequente conteúdo e alcance, visando à superação da arquitetura da impunidade.
O fenômeno da judicialização é de especial importância para a compreensão do processo de institucionalização dos direitos de pessoas lésbicas, gays, bissexuais e trans (LGBT) no cenário brasileiro. Acompanhando as tradições constitucionais europeias do pós-Segunda Guerra e se alinhando com algumas daquelas constituições do chamado "novo constitucionalismo latino-americano", a Constituição Brasileira de 1988 tem um texto de caráter substantivo, com grande ampliação da pauta de direitos. No entanto, ainda que seu texto apresente direitos bem demarcados para grupos historicamente oprimidos, como mulheres e negros, não apresenta nenhuma previsão específica relativa às pessoas LGBTs.
O trabalho investiga a abrangência da proteção conferida pelas normas de direito internacional às pessoas LGBTIs. Sob o marco teórico do reconhecimento enquanto status social, proposto por Nancy Fraser, questiona-se se o direito internacional fornece proteção e reconhecimento suficientes aos LGBTIs, utilizando-se o método jurídico-compreensivo de investigação e as técnicas de revisão bibliográfica, análise documental e pesquisa jurisprudencial. Os resultados obtidos revelam a ausência de direitos aos LGBTIs em documentos internacionais vinculantes, bem como uma jurisprudência que garante direitos a esses indivíduos majoritariamente sob o fundamento do direito à privacidade. Concluiu-se, portanto, pela existência de um paradigma que se chamou de Direito Internacional Monocrático, isto é que não fornece reconhecimento ou proteção suficientes aos LGBTIs, invisibilizando-os.
RESUMOO descompasso entre uma relevante parte da doutrina administrativista pátria e os novos paradigmas trazidos pelo Pós-Positivismo justificou o presente trabalho, que tem o escopo de realizar a revisão dos paradigmas do Direito Administrativo sob o lume deste marco teórico, marcadamente pelas obras de Robert Alexy e Ronald Dworkin. Dessa maneira, através do método dedutivo de pesquisa, realizou-se a releitura histórica e científica de quatro pilares da dogmática administrativa: o princípio da legalidade, o princípio da supremacia do interesse público, a discricionariedade e o ato administrativo. Através deste esforço, propõe-se a adaptação dos referidos pilares aos mandamentos constitucionais e à consolidação do Estado Democrático de Direito.Palavras-chave: Direito Administrativo; Discricionariedade; Interesse público; Juridicidade; Processo administrativo. ABSTRACTThe justification of this paper is the mismatch between a great part of the Brazilian Administrative Law literature and the new scientific referential brought by Post-Positivism, and its proposal is to review the main principles of the Administrative Theory under the post-positivist perspective, mainly guided by Robert Alexy's and Ronald Dworkin's work. Thus, through the deductive research method, the four core pillars of Administrative Law were historically and scientifically reviewed: the legality principle, the supremacy of public interest principle, the administrative discretion and the administrative act. O trabalho investiga a proteção das pessoas trans na jurisprudência da Corte Europeia de Direitos Humanos. A análise jurisprudencial é justificada na ausência de disposições legislativas sobre a proteção LGBTI no direito internacional, no âmbito global e regional. Valendo-se do marco teórico da teoria da justiça de Nancy Fraser, questiona-se se as decisões da Corte auxiliam no reconhecimento dessa população. O estudo se divide em três partes: revisão bibliográfica acerca do marco teórico e da especificação dos direitos humanos; pesquisa empírica e exploratória sobre as decisões da Corte Europeia em matéria de identidade de gênero; análise crítica dos dados encontrados na fase exploratória. Os resultados obtidos apontam para uma parcial contribuição da jurisprudência do órgão para as políticas de reconhecimento, que, apesar de apresentar certo grau de especificação, são fundamentadas em discursos que não contribuem para a reconfiguração dos padrões de subordinação social e cultural da população trans.
