Waqaf is basically seen as one of the religious institutions in Islam which is relevant and functionally efforts to solve socio-economic problems and humanity, such as poverty alleviation, human resource development, and economic empowerment. The endowments are absolutely an important role in achieving a just social order. From the perspective of shapes, endowment money is seen as one of the solutions that can make endowments to be more productive. Because the money here will no longer to be used as a means of exchange, but more than it, we can explore it as a commodity to produce in the terms of economic development. Therefore, the cash money in the form of waqaf of money can result any benefit for the community. Appearances distribution of endowments can be used to productive activity in the era of economic downturn of the Islamic community in Indonesia. Now it should become the primary choice. In another sense, it is a productive waqaf endowment that must be a priority and dedicated its efforts to more fruitful. Thus, the sizes of different paradigms are done by the consumptive waqaf, because it gives a new hope for the majority of the Muslim community. Endowments are not willing to lead in worship of mahdhah which is directed to the consumptive waqaf. Using the findings of waqaf has been prioritized to give benefit in a very broad, including for economic empowerment, such as public facilities and worship activities, social facilities and educational activities as well as health, aid to poor people, displaced children, orphans, scholarship, progress and economic improvement for the people who needs the advancement of public welfare other non-contrary to the sharia business law.
Mengidentifikasi beberapa faktor yang berpengaruh terhadap return saham syariah menjadi latar belakang utama penelitian ini. Penelitian ini bertujuan untuk mengetahui pengaruh faktor eksternal, berupa Inflasi, harga emas, dan tingkat suku bunga terhadap return saham syariah di Indonesia selama periode tahun 2017-2020. Metode penelitian yang digunakan kuantatif dengan analisis regresi berganda. Sampel pada penelitian ini merupakan perusahaan-perusahaan yang terdaftar dalam JII (Jakarta Islamic Index) yang berjumlah 30 emiten. Dengan menggunakan teknik purposive sampling, diperoleh sampel sebanyak 13 emiten syariah. Adapun metode analisis data yang digunakan dalam penelitian ini adalah analisis deskriptif, uji asumsi klasik dan uji hipotesis dengan menggunakan software Eviews 10. Berdasarkan hasil analisis data dapat disimpulkan bahwa secara parsial inflasi berpengaruh terhadap return saham syariah, sedangkan harga emas dan tingkat suku bunga tidak berpengaruh terhadap return saham syariah. Sedangkan secara simultan inflasi, harga emas, dan tingkat suku bunga tidak berpengaruh terhadap return saham syariah di Indonesia.
This study aims to determine Islamic philanthropy in a modern context. Islamic philanthropy is taken from the religious doctrine of the Qur'an and hadith as a human and religious commitment so that Islamic charity appears as zakat, infaq, alms, and endowments. This type of research is qualitative with a literature study method. Data collection techniques in literature study are through books, articles, journals, and research reports related to the problem being researched. The results of the study found that in Indonesia, practices in zakat, waqf, infaq, and sadaqah (Ziswaf) are seen as economic symbols of justice and democracy, being able to place economic resources in their proper place. In conclusion, Islamic philanthropy in the modern context is a stylish way of managing one's social generosity in the context of carrying out muamalah activities among fellow human beings.
This research discusses mixed marriage which is very controversial in society, even though most religions have prohibited the practice of mixed marriage. In Decree No. 454/Pdt.P/2018/PNSKt. The judge allowed the marriage of someone of a different religion, even though the Marriage Law clearly does not regulate and returns to the laws of each religion. HKI (Compilation of Islamic Law) prohibits the practice of interfaith marriage as stated in Article 40 letter c. This study aims to analyze the judge's considerations in granting or rejecting interfaith marriages with the applicable laws in the marriage law and KHI (Compilation of Islamic Law). The research method used is qualitative (library research) with a normative legal approach as an analytical tool to describe existing problems and gain insight. The results of this study indicate that the determination of interfaith marriages in Decision No. 454/pdt.p/2018, it is only the subjectivity of judges in interpreting Article 2 (1) of the Marriage Law and legalizing interfaith marriages which are in stark contrast to the Compilation of Islamic Law which has been in force in the Religious Courts in Indonesia.
Differences in marriage and divorce law in Islamic and state law One of the triggers for the initial causes of the disorderly implementation of marriage and divorce in the Sukajadi Bandung community was an understanding regarding the separation of religion and state law as well as social welfare factors related to law enforcement. This study analyzes the legal consequences, factors, and legal remedies that can be taken in unregistered marriages and divorces. The method used in this study is empirical-juridical with a qualitative approach. This approach is carried out to obtain information in the Sukajadi Bandung community regarding unregistered marriages and divorces. The results of the study show that the factors behind the rampant practice of unregistered marriages and divorces are not recorded because people's understandings of the dichotomy between Islamic law and that of the state are different. There is a link between the legal awareness of the community and its understanding of religion and welfare. In addition, unregistered marriages and divorces have an impact on the absence of marriage, inheritance, custody, and maintenance, which are detrimental to children and wives. Several efforts need to be made to minimize the occurrence of unrecorded marriages and divorces, including counseling, legal assistance for divorce victims, mediation, and consultation. This effort does not only involve the government and law enforcers but also preachers, lectors, and social organizations.
