Peran Kearifan Lokal Masyarakat Membuka Lahan dengan Cara Membakar sebagai Upaya Mencegah Kebakaran Hutan dan Lahan Ali Imran Nasution[1], Taupiqqurrahman[2] Abstract The majority of Indonesian people's livelihoods are farming, which requires a lot of land to be used as agricultural field. Limited land requires clearing land from forests so that it can be used as new land for farmers. Clearing land by cutting and burning trees in a forest area is prohibited by law. However, there are exceptions to local wisdom which burns land with a maximum land area of 2 hectares per family to be planted with local varieties of plants and surrounded by firebreaks to prevent the spread of fire to the surrounding area. The purpose of this study is to analyze the role of local wisdom in clearing land by burning in an effort to prevent forest and land fires and the law enforcement against violations of the rules on how to clear land by burning. The research method uses the type of normative legal research with the statue approach and conceptual approach. The results showed that the role of local wisdom in burning forests by local wisdom received constitutional recognition and could prevent extensive forest fires. Keywords: Local Wisdom, Burning, Preventing Forest Fires Abstrak Mayoritas pencaharian masyarakat Indonesia adalah bertani, yang tentunya membutuhkan banyak lahan untuk dipakai sebagai lahan bertani. Keterbatasan lahan membutuhkan pembukaan lahan dari hutan agar dapat dijadikan lahan baru bagi petani. Membuka lahan dengan cara menebang dan membakar pohon di kawasan hutan adalah perbuatan yang dilarang oleh undang-undang. Namun, terdapat pengecualian terhadap kearifan lokal yang melakukan pembakaran lahan dengan luas lahan maksimal 2 hektar per kepala keluarga untuk ditanami tanaman jenis varietas lokal dan dikelilingi oleh sekat bakar sebagai pencegah penjalaran api ke wilayah sekelilingnya. Tujuan penelitian ini menganalisis peran kearifan lokal membuka lahan dengan cara membakar sebagai upaya mencegah kebakaran hutan dan lahan serta penegakan hukum terhadap pelanggaran ketentuan tata cara membuka lahan dengan cara membakar. Metode penelitian menggunakan jenis penelitian hukum normatif dengan pendekatan undang-undang (statue approach) dan pendekatan konseptual (conseptual approach). Hasil penelitian menunjukkan peran kearifan lokal membakar hutan dengan cara kearifan lokal mendapat pengakuan konstitusional dan dapat mencegah kebakarn hutan yang luas. As a village located on the coast, Pabean Udik Village has many problems which are covered in environmental hygiene aspects. This Community Service contains an environmental framework in supporting the circular economy concept, given the increasing interest of practitioners and theorists in the circular economy. The method of implementing this Community Service uses the Preparatory Stage which includes the process of field visits, handling priority issues and data collection and needs analysis followed by the Implementation Phase with Hearings, Compilation of Village Regulations and Peer Review. The results of the draft Village Regulations that had been prepared by the Service Team have been received by the Head of the Udik Customs Village which is expected to be resolved to become a legal umbrella as an effort to resolve the problem of disposing of garbage. the results of observations during the activity show that the importance of knowledge of the surrounding community about the importance of environmental cleanliness interspersed with qualified technology, especially through legal arrangements for payments related to bank waste. It is hoped that this service activity can be continued in the following year so that people can understand the importance of environmental cleanliness with the existence of a legal umbrella.
Peraturan daerah merupakan bagian dari peraturan perundang-undangan yang ada di Indonesia. Dalam hierarki peraturan perundangan-undangan sebagaimana diatur dalam Undang-Undang Nomor 12 Tahun 2011 bahwa Perda kabupaten/kota berada diurutan ketujuh setelah Perda Propinsi. Kabupaten Bungo sebagai daerah yang otonom, mempunyai kewenangan untuk menetapkan peraturan daerah. Dalam kurun waktu Tahun 2016-2019 pemerintahan daerah kabupaten Bungo sudah menetapkan 61 Perda. Perda yang ditetapkan sudah berdasarkan berdasarkan Program pembentukan peraturan daerah. Propemperda merupkan instrumen perencanaan program pembentukan perda yang disusun secara terencana, terpadu, dan sistematis. Dalam penetapan Propmerda bagian dari kewenangannya DPRD. Dalam Pasal 149 Undang-Undang Nomor 23 Tahun 2014 DPRD mempunyai 3 fungsi, yang salah satunya adalah Pembentukan Peraturan Daerah.
National development as one of many efforts to constitute Indonesia government ideals. As the head of government, President of Republic of Indonesia has fully responsible to carry out national development program. To exercise his duty, President will be assisted by ministries who capable and professional on their field. Nonetheless, the already formed ministry oftentimes have gone through nomenclature changes as well as at the beginning of forming or during its Presidential running period. State ministry nomenclature changes can be done by merging or split the ministry. Primarily, it needs consideration of House of Representative to change a ministry nomenclature, while for dismissal proceed needs to be approved by House of Representative. This study aims to understand the regulation of changing ministries nomenclature and how it will affect national development. The methodology uses in this study is normative research by statutory and conceptual approach. The results indicate that the timing of changing ministry's nomenclature raises ambiguity. Changes in ministries nomenclature amidst of President's leadership have affected on ministry's work programs implementation that have been prepared by prior ministries.
The purpose of this study is to analyze the legal basis for the authority to form Joint Ministerial Regulations and how the legality of Regional Regulations that incorporate Joint Ministerial Regulations as the legal basis for establishing regional regulations. The research method used is normative legal research with statutory approach and conceptual approach. The results showed that the establishment of a Joint Ministerial Regulation did not have attribution or delegation authority. Thus, according to the formal principle of the formation of statutory regulations, Regional Regulations that put Joint Ministerial Regulations as a legal basis for the formation of legislation are formally unlawful.
Polemik tentang Presiden berwenang atau tidak berwenang memberhentikan kepala daerah muncul kembali saat pemerintah mengusulkan Rancangan Undang-Undang Cipta Kerja. Disebutkan sebelumnya di dalam draft Rancangan Undang-Undang Cipta Kerja bahwa Presiden dapat memberhentikan kepala daerah yang tidak melaksanakan Program Strategis Nasional. Setelah disahkannya Rancangan Undang-Undang Cipta Kerja menjadi undang-undang, rumusan tersebut tidak dicantumkan. Namun demikian, rumusan Pasal tersebut sudah ada di dalam ketentuan Pasal 68 Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah. Permasalahan yang muncul dalam penelitian ini adalah apa dasar teoretis Presiden berwenang memberhentikan kepala daerah dan bagaimana tata cara pemberhentian kepala daerah yang tidak melaksanakan Program Strategis Nasional. Metode penelitian menggunakan jenis penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa dasar teori penjatuhan sanksi adminsitratif adalah berdasarkan teori sistem pemerintahan presidensial dan konsepsi negara kesejahteraan yang dianut oleh Indonesia. Prosedur pemberian sanksi ini dilakukan secara hierarkis melalui jalur non-pengadilan. Perlu dibuat aturan pemberian sanksi melalui jalur pengadilan untuk memberikan kepastian hukum dan mencegah munculnya penyalahgunaan wewenang oleh Presiden.
In 2020, the President of Indonesia established Presidential Regulation Number 99 of 2020 concerning the Procurement and Implementation of Vaccinations to Annihilate Covid-19 Pandemic. Furthermore, this Presidential Regulation was amended by Presidential Regulation Number 14 of 2021 which contained a particular provision to impose legal sanctions on people who violated rules by do not participate in Covid-19 vaccination. Administration sanctions such as postponing or terminating social security awarding or social assistance will be imposed on a citizen who does not comply with that particular provision. This kind of administrative sanction will potentially harm the rights of lower classes people. This study is to analyze the ambiguity of legal sanctions against people who refuse to get Covid-19 vaccination and to analyze the alternative solution to take out the ambiguity of imposing sanctions on people who violated these particular rules. This research method uses normative legal research by statutory and conceptual approach. This study concludes that the ambiguity caused by those sanctions is contradicted with the legislation rules and principles.
