How are legal matters related to the access of traditional knowledge being considered in the scope of ethnobotany publications in Brazil?

Legal measures, such as the use of free or prior and informed consent, return of research results to communities (which can be understood as "sharing of benefits, " according to Brazilian legislation), and research authorization by governmental bodies, are mentioned and regulated in various documents, either governmental or specific, within the area of ethnobiology. This study aims to explore how these matters are considered in the scope of published ethnobotany articles in Brazil, as well as whether the creation of the Provisional Measure 2.186-16/2001 has contributed to the national advance of these matters. The methodology comprised a literature review of articles focusing on medicinal and food plant resources in the prominent Brazilian journals which publish ethnobotany studies. From 137 articles analyzed, 8 mentioned the return of research results to the community; 21 explicitly cited the use of free or prior and informed consent; and 13 mentioned the authorization of governmental bodies. We expect that the present study will contribute to the debate regarding the necessity of reformulation of the current system, which would guarantee a more effective rapport between the government, researchers, local communities, and society and contribute to the development of ethnobotany in Brazil.

Resumo -A produção de frutos de açaí é proveniente, em sua maioria, do extrativismo, mas existe uma forte tendência de implementação de cultivos comerciais. A colheita dos frutos é realizada exclusivamente por escaladores, que se arriscam a sofrer acidentes, além de não terem grande eficiência na colheita. O objetivo deste trabalho foi realizar os desenhos conceituais de colhedoras autopropelidas de açaís em ambientes de matas de terra firme, matas de várzea e cultivos comerciais. Para tal foi utilizada a metodologia de projeto de matriz morfológica. Como resultados foram obtidos os desenhos conceituais destas novas colhedoras: Colhedora de açaí para matas de várzea nativas em estação de cheia; Colhedora de açaí para matas de terra firme nativas e matas de várzea em estação de seca; Colhedora de açaí para cultivos comerciais. Amazônia.Abstract -Production of the açai fruit is mainly accomplished through manual collection; but there is a strong trend towards the implementation of commercial crops. Fruit harvesting is carried out exclusively by climbers who risk injury to themselves, besides not being very efficient at harvesting. The aim of this study was to produce design concepts for self-propelled açai harvesters for dry-land forest environments, floodplain forest environments and commercial crops. To this end we used the design methodology of a morphological matrix. The results obtained were the design concepts for the following new harvesters: an açai harvester for native floodplain forests in the wet season; a harvester for both dry-land and native floodplain forests in the dry season; a harvester for commercial crops.

This article described and analyzed the tree and shrub species composition of homegardens in a rural community in Eastern Amazon, Brazil. Data were collected from 30 homegardens stratified into two groups of 15: homegardens of northeastern and homegardens of peasants from South Brazil, based on floristic surveys of 100% of the tree and shrub components. We studied the floristic composition and the preference value index (PVI), and classified the homegardens by cluster analysis. In the evaluated homegardens, 2270 vegetable plants of 67 species, 53 genera and 28 botanical families were recorded. The most representative families, according to the number of species, were Arecaceae, Rutaceae, Myrtaceae, Annonaceae, and Caesalpiniaceae. Cocos nucifera (coconut) had the highest PVI (97.37), followed by banana, orange, peach palm and avocado, confirming the preference for fruit species with commercial value. The floristic composition of homegardens revealed that coconut is the most commonly cultivated species. The species diversity in the homegardens was moderate, and evenness was considered medium, despite the dominance of species such as banana and açaí palm. The origin of the farmers did not influence the similarity among homegardens, but it influenced vegetal species richness, diversity and density, which were higher in the southerners' homegardens. Resumo Biodiversidade de espécies arbóreas e arbustivas em quintais agroflorestais em comunidade rural na AmazôniaOriental: Este artigo descreveu e analisou a composição florística dos estratos arbóreos e arbustivos de quintais agroflorestais de uma comunidade rural na Amazônia Oriental, Brasil. Os dados foram coletados a partir de 30 quintais, estratificados em dois grupos de 15: quintais manejados por agricultores provenientes do nordeste brasileiro e por oriundos da região sul do Brasil, com base em levantamentos florísticos de 100% dos componentes de árvores e arbustos. Estudou-se a composição florística e o índice de preferência valor (IVP), e classificou-se os quintais por meio de análise de cluster. Nos quintais avaliados, foram registrados 2270 indivíduos pertencentes a 67 espécies, 53 gêneros e 28 famílias botânicas. As famílias mais representativas, de acordo com o número de espécies, foram: Arecaceae, Rutaceae, Myrtaceae, Annonaceae e Caesalpiniaceae. Cocos nucifera (coco) teve o maior IVP (97,37), seguido pela banana, laranja, pupunha e abacate, indicando preferência por espécies de frutas com valor comercial. A composição florística revelou que o coco é a espécie mais cultivada. A diversidade de espécies nos quintais foi moderada, e a riqueza, considerada média, apesar da dominância de espécies, como banana e açaí. A origem dos agricultores não influenciou na semelhança entre quintais, mas influenciou na riqueza, densidade e diversidade de espécies vegetais, sendo maiores nos quintais manejados por agricultores oriundos da região sul do Brasil.
