A audiência de custódia consiste na apresentação do preso em flagrante em 24 horas diante do juiz para que ele decida a manutenção ou não da prisão, e passou a ser implementada em 2015 por ação do Conselho Nacional de Justiça (CNJ) nos Tribunais de Justiça dos estados. Em São Paulo, essas audiências foram implementadas no Fórum Criminal da Barra Funda a partir de fevereiro de 2015. De acordo com o CNJ, tais audiências tinham por objetivo averiguar a necessidade da manutenção das prisões, avaliar a legalidade de tais detenções e se atentar para a violência policial e tortura possivelmente praticada contra presos. O principal argumento para adoção dessa audiência é a necessidade desencarceramento. Contudo, a sua implementação gerou controvérsias, sobretudo entre as organizações policiais. A Associação de Delegados de São Paulo chegou a mover uma Ação Direta de Inconstitucionalidade contestando a aplicação dessas audiências. Policiais militares e civis dizem que tais audiências colaboram para o “aumento da impunidade”, “solta bandidos perigosos”, que quando preso diz que apanhou da polícia “o juiz solta”, dentre outras falas que demonstram a insatisfação desses policiais com relação as audiências de custódia. Analisando pesquisas já realizadas sobre as audiências de custódia, é possível perceber que a menção à tortura ou violência não motiva a soltura das pessoas presas, muito menos juízes parecem se importar tanto com essa questão. Na mesma medida, não parece que tais audiências soltam “geral” como aparece nas falas dos policiais. Então, por que tais narrativas circulam nas instituições policiais? Quais efeitos elas podem ter na dinâmica do trabalho policial e na relação da polícia com o Poder Judiciário?
Neste texto, apresentamos e discutimos alguns dados de survey repetido ao longo da primeira década dos anos 2000 sobre as percepções e expectativas da população em relação à justiça. Dado o papel do Judiciário na garantia do estado de direito democrático, um dos elementos-chave para a democracia, pressupomos que o acompanhamento da imagem dessa instituição pela população pode contribuir para seu fortalecimento, em especial quando cresce no mundo uma insatisfação com várias instituições. Os dados apresentados foram coletados na cidade de São Paulo entre os anos de 2001 e 2013, e revelam um quadro complexo em que certa insatisfação em relação à justiça combina com fortes expectativas positivas da atuação de juízes.
O discurso teológico ainda hoje é entendido como algo restrito ao âmbito eclesiástico e clerical. Porém, cada vez mais percebe-se a abertura ao diálogo e a ampliação de seus horizontes, dentro de um mundo globalizado e secularizado. O diálogo acontece quando há proximidade de seus interlocutores. Por essa razão, o presente trabalho visa à aproximação entre Teologia e Literatura, esta última muito bem representada por Machado de Assis. Em sua obra Memórias Póstumas de Brás Cubas, encontramos uma visão de homem machadiana. Ora, a Teologia sabidamente não se faz sem a Antropologia. Desse ponto em comum, vemos brotar o pensar sobre Deus, que se fez Homem para nos salvar.
