Dans un contexte d'innovation ouverte, les relations entre laboratoires publics et industriels sont en développement mais elles sont rendues complexes par de fortes divergences concernant leur vision de l'appropriation des savoirs. Alors que les problèmes relatifs à la propriété intellectuelle sont initialement accentués par les représentations réciproques desacteurs, c'est la mise en oeuvre de projets communs qui permet de réduire progressivement les antagonismes entre les acteurs.
Cet article s'intéresse aux actions mises en oeuvre par les entreprises innovantes afin d'influencer le contexte institutionnel et réglementaire. L'innovation se trouve en effet confrontée, par nature, à un environnement institutionnel non adapté, voire contraignant. Comment, dans ce cas, les entreprises innovantes parviennent-elles à modifier cet environnement dans un sens qui soit favorable à leurs innovations ? Cet article propose un cadre théorique pour l'analyse de la stratégie politique ou « hors marché » de l'entreprise innovante. Six configurations types ont été identifiées selon l'impact concurrentiel d'une innovation et le rôle de la décision publique dans la diffusion de l'innovation.Ces configurations amènent à des stratégies d'influence différentes de la part des entreprises innovantes. Une seconde partie développe, sous forme d'hypothèses, les différentes formes et modes d'influence pouvant être émises par l'entreprise innovante.
La cohabitation entre une exigence accrue de performance publique formalisée par des objectifs précis à atteindre et l’éthique traditionnelle du service public à la française ne va pas sans créer des tensions. Celles‑ci s’expriment particulièrement dans le domaine de la recherche publique qui doit démontrer son utilité socio‑économique via des indicateurs de performance qui incitent ses opérateurs à protéger juridiquement et valoriser financièrement leurs résultats scientifiques. Ainsi, l’éthique traditionnelle de « science ouverte » doit‑elle composer avec les impératifs de performance économique. Plutôt que d’opposer ces deux enjeux, nous nous proposons de montrer comment ils pourraient s’articuler en développant des stratégies en matière de propriété intellectuelle équilibrées pour peu que la définition de la performance publique dans ce domaine ne se limite pas à des objectifs trop étroits.
Notre recherche porte sur l’analyse des types de trajectoires que peut suivre le montant de la collecte lors de campagne de crowfunding . 226 projets de crowdfunding ont été suivis sur la plateforme KissKissBankbank, en relevant, chaque jour, les sommes collectées et en portant une attention particulière au début de campagne. Les résultats de notre recherche montrent très clairement que les premiers jours sont déterminants pour le succès ou l’échec final d’une collecte et que les dynamiques de succès et d’échec s’infléchissent rarement. Ceci nous conduit à une série de propositions et à insister sur deux pistes de prolongement de cette recherche, l’une théorique autour du concept de légitimité et l’autre empirique en préconisant une analyse approfondie des phases de précampagne. Recent publications in the field of Intellectual Property (IP) have shown that the previous literature did not grasp how complex patents are. The goal of this paper is to present an overview of all identified functions of patents and of the main strategic implications of such a complex picture. We first survey the main patent functions: innovation protection, functions related to trade and finance, defensive roles, and patent as an input in the innovation process. We then define each function and analyse their main evolution trends in relation with the current environment. We finally identify the strategic implications of each function. We focus on the implications of the newly identified functions and on the interaction between the different functions. RésuméLa littérature récente sur les brevets montre combien ils sont complexes. Le but de ce papier esr de fournir un survol des fonctions du brevet et de leurs implications stratégiques. Nous passons en revue les principales fonctions: protection de l'innovation, fonctions relatives à l'échange et à la finance, role défensif du brevet, l'usage du brevet comme input dans le processus d'innovation. Pour chaque fonction nous analysons ses pricipales tendances d'évolution dans le contexte contemporain. In fine, on identifie les implications stratégiques de chaque fonction. On s'intéresse en particulier aux implications des fonctions nouvelles et à leurs interactions.
