A modernidade chegou e sempre outra estará por vir e diante dos avanços tecnológicos e das modernas técnicas de propagação da informação e dados a sociedade ampliou sua forma de interação. As importantes mudanças que o mundo econômico, social e jurídico está percebendo trouxe a necessidade de adequação cultural, moral. Em consequência isso implica dizer que ética precisa ser repensada no mesmo compasso que o agir humana se apresenta de forma diversa que em outras eras apresentou. O presente trabalho tem por objetivo o estudo dos princípios constitucionais, em especial do princípio da presunção de inocênciafrente a natureza híbrida da colaboração premiada. A importância da presunção de inocência, segundo as opiniões de doutrinadores e da jurisprudênciaformadaaolongo do tempo, levou ao seu reconhecimento como princípio constitucional expressamente descritono art. 5º, inciso LVII, da Constituição Federal de 1988, que estabelece que “ninguém será considerado culpado até o trânsito em julgado de sentença penal condenatória”, gerando relevantes reflexos no Direito Penal e servindo de base estruturadora do Direito Processual Penal. A enunciação deste princípio, após o julgamento do habeas corpus 126.292 peloSupremo Tribunal Federal, trouxe grande discussão, tendo em vista a mutação de entendimento do texto constitucional, autorizando a prisão para cumprimento de pena após decisão em Segundo grau, mesmo que ainda não transitada em julgado. Apesar de muitos posicionamentos contrários, alertando sobre a relativização do princípio da presunção de inocência, o Supremo Tribunal Federal se atentou a analisar o contextonormativo de forma sistemática, entendendo pela preservação do princípio, da mesma forma que fez o texto normativo sobre a colaboração premiada, procedimento investigativo de natureza híbrica. A par disso, este trabalho dedica espaço à análise da colaboração premiadaem face ao direito brasileiro e, para tanto, discorre sobre a colaboração premiada no ordenamento jurídico brasileiro com o advento da Lei no 12.850 de 2013, como forma de trazer singela contribuição científica na demonstração de que a justiça penal consensuada garante ao investigado ou acusado os direitos derivados deste Estado Democrático, dentre eles o devido processo legal, a ampla defesa, o contraditório e a presunção de inocência.
A sustentabilidade passou a ser obrigatória na dinâmica dos contratos públicos e não apenas uma mera ferramenta discricionária de ou conveniência oportunidade da Administração Pública, especialmente a partir do advento da Constituição Federal de 1988 e do recrudescimento da legislação infra-constitucional ambiental, administra-tiva e penal. O contrato, portanto, deve cumprir sua função social com observância à sua responsabilidade ambiental, econômica e social, sob pena de ilegalidade. A análise da defesa do meio ambiente deve ser uma escolha de política públicas antes mesmo da realização das licitações e contratos, cuja fiscalização e controle se es-tendem não só no momento de execução ou contrato, mas, inclusive, posterior-mente a ele.Palavras-chave: Sustentabilidade. O artigo faz breve apanhado dos conceitos de sustentabilidade e desenvolvimento social. Aborda as faces ambiental, social e econômica da sustentabilidade, além de seus subprincípios e sua matriz constitucional. Faz digressão sobre a reflexividade política do perigo, para se despertar a consciência social dos riscos trazidas pelas novas tecnologias. Discute o papel do Estado moderno, tanto no aspecto normativo, como os impactos gerados pelo exercício de suas atividades materiais.
