Resumo: O objeto do presente artigo (que aqui, apenas casualmente, guarda convergência temática com seu objetivo geral) é examinar a distinção no âmbito da filosofia e da teoria do direito entre uma abordagem descritiva da forma jurídica, isto é, como ela examina fatos, valores e normas, daquela outra, prescritiva, que trata de como eles deveriam ser. Portanto, a problemática, isto é, aquele campo de questões que demarcam um campo de reflexão, se expressa num problema pelo qual o objeto será inquirido, qual seja, o de saber se a transposição do mundo dos fatos para o dos valores, sem mais justificação, é possível ou se a navalha humeana segue sendo metodologicamente adequada para o exame da forma jurídica. A hipótese, reiterada nas pesquisas independentes quer do autor quer da co-autora, aponta no sentido de ser metodologicamente mais eficaz, para se fazer filosofia do direito tratar esse objeto como ele é, efetivamente, e não como deveria ser, ainda que, num campo específico da filosofia moral, possa ele ser tratado de forma prescritiva, mas ao custo de examinar o seu ser, o que só se pode fazer em abordagem filosoficamente descritiva.
