O artigo, mediante pesquisa bibliográfica e jurisprudencial, utilizando-se do método dedutivo, analisa quatro normas de transição das Emendas Constitucionais n° 20/98, n° 41/03 e n° 103/19, que procederam a uma superposição normativa, majorando o pedágio de tempo do segurado de 20% para 50% no Regime Geral de Previdência Social e de 20% para 100% no Regime Próprio de Previdência Social dos servidores públicos, incorrendo em inconstitucionalidade por ofensa aos postulados da segurança jurídica, segurança social, boa-fé, confiança legítima, direito expectado, proporcionalidade, razoabilidade e igualdade.
Este artigo propõe-se a discutir, sob o paradigma do Estado Democrático de Direito, em que medida a aplicação da cota de gênero contribui para fomentar a representatividade feminina na política. Utilizam-se a pesquisa bibliográfica e o método jurídico-dedutivo. Os resultados sinalizam que não há uma correlação necessária entre o preenchimento da cota de gênero e o incremento do número de candidatas eleitas. Os resultados apontam que a superação dessa desigualdade requer a discussão de outras possibilidades, tais como reserva de vagas no Legislativo, combate às candidaturas femininas fictícias e aplicação obrigatória de recursos nas campanhas femininas.

Este artigo versa sobre a teoria dos precedentes judiciais estadunidense de referencial obrigatório dos fatos e sua adaptação ao modelo brasileiro de fixação de tese jurídica vinculativa pautada na razão de decidir. Os julgados que direcionam a solução de controvérsias posteriores são parâmetros utilizados na verificação da distinção entre a questão a ser solucionada no caso concreto e a tese impositiva, pretérita, genérica e abstrata. Na investigação adota-se pesquisa bibliográfica, por meio do método dedutivo e comparativo, com foco na tendência de universalização de ideias e de uniformização jurisprudencial do Supremo Tribunal Federal.
