O objetivo do presente artigo é apresentar os aspectos contemporâneos no que tange a observância dos princípios do contraditório e da ampla defesa no Processo Ad-ministrativo Disciplinar, em comparação a processualidade do Processo Administrativo de Responsabilização de Pessoa Jurídica, este oriundo da Lei Anticorrupção, e ambos da competência da Controladoria-Geral do Estado de Minas Gerais. São processos dife-rentes, tendo em vista que visam respectivamente apurar possíveis responsabilidades funcionais e de atos lesivos praticados por empresas, todavia, em ambos possuem o as-pecto sancionador. Visando o aprimoramento dos citados princípios no Processo Ad-ministrativo Disciplinar mineiro, pretende-se analisar sobre a importância do estudo da contemporaneidade hermenêutica do direito sancionador; diferenças processuais na le-gislação mineira entre o Processo Administrativo Disciplinar e o Processo Administra-tivo de Responsabilização de Pessoa Jurídica e as propostas de aprimoramento do Pro-cesso Administrativo Disciplinar mineiro. A metodologia será a jurídica-dogmática, uti-lizando o método hipotético-dedutivo. O marco teórico é a “Teoria constitucionalista do processo” a qual se posiciona pela valoração constitucional dos princípios do contraditó-rio e da ampla defesa, tanto no âmbito judicial quanto no administrativo, em cumprimen-to ao Estado Democrático de Direito, que impõe em sede administrativa a isonomia entre as partes, Administração Pública e administrados, estando nestes incluídos os servido-res públicos e particulares quando demandados em processos sancionadores.
