Penelitian ini bertujuan membahas mekanisme pemilihan kepala daerah di Indonesia, dengan melakukan perbandingan sistem pemilihan kepala daerah di sejumlah negara, antara lain: Amerika Serikat, Belanda, dan India. Mekanisme ini sebagaimana dalam Pasal 18 ayat (4) UUD NRI 1945 yang menyebutkan bahwa gubernur, bupati, wali kota masing-masing sebagai kepala pemerintahan provinsi, kabupaten dan kota, dipilih secara demokratis. Frasa dipilih secara demokratis selalu ditafsirkan bahwa pemilihan kepala daerah harus dilakukan secara langsung oleh rakyat. Penelitian ini menggunakan penelitian yuridis normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan perbandingan. Penelitian menemukan bahwa potret pemilihan kepala daerah saat ini menunjukkan bahwa pemerintah belum mampu menciptakan kesejahteraan rakyat, bahkan menyebabkan semakin rusaknya moral para pejabat negara dan rakyatnya. Regional Election in Indonesia and the Comparison in United States, Netherlands, and India This research aims to discuss the mechanism of regional election in Indonesia by compairing it with others country, which are United State, the Netherland, and India. This mechanism as in Article 18 paragraph (4) of the Indonesian Constitution 1945 (UUD 1945) which state that the governors, regents and mayors as heads of provincial, district and city governments, are democratically elected. The phrase democratically is always interpreted that the regional election must be carried out directly by the people. This study applies normative juridical research by using a statutory approach and a comparative approach. The study found that the current portrait of regional elections shows that the government has not been able to create people's welfare, even causing moral damage to state officials and people.
Qanun Number 8 of 2016 regulates the Halal Product Guarantee System, but there are still many business actors in Banda Aceh who do not have halal certificate for the food they sell. This journal aims to further examine the protection for Muslim consumers regarding food products or places of business that do not have a halal certificate and logo given by LPPOM Aceh and to find out the effectiveness of LPPOM MPU Aceh in providing guidance and supervision over food products distributed in Aceh. The method and type of writing is empirical-legal by conducting interviews with the Aceh MPU LPPOM. This writing approach is known as an empirical socio-legal study. Based on the research results, the legal protection for Muslim consumers regarding food products or places of business that do not have a halal certificate and logo is regulated in the Qanun SJPH. The inclusion of the halal logo is mandatory. However, there are business actors who still have not applied to obtain halal certification. This happened because LPPOM experienced obstacles in terms of guidance and supervision over halal food sold in Aceh and the absence of regulations concerning the Qanun SJPH implementation.Qanun Nomor 8 Tahun 2016 bertuliskan tentang Sistem jaminan Produk Halal, namun masih banyak pelaku usaha makanan di Banda Aceh yang tidak melakukan sertifikasi makanan halal terhadap makanan yang dijual. Tujuan penulisan jurnal ini adalah untuk mengkaji lebih lanjut terhadap perlindungan konsumen muslim pada produk atau tempat usaha makanan yang tidak memiliki sertifikat dan logo halal LPPOM Aceh efektivitas LPPOM MPU Aceh dalam melakukan pembinaan dan pengawasan terhadap produk makanan yang beredar di Aceh. Metode dan jenis penulisan ini bersifat yuridis empiris dengan melakukan wawancara kepada pihak LPPOM MPU Aceh. Pendekatan penulisan ini disebut dengan penelitian empirik dan hukum sosiologis. Berdasarkan hasil penelitian Perlindungan hukum konsumen muslim terhadap produk atau tempat usaha makanan yang tidak memiliki sertifikat dan logo halal di atur dalam Qanun SJPH. Pencantuman logo halal bersifat wajib. Namun kenyataannya masih ditemukan pelaku.usaha yang belum melakukan sertifikasi.halal. Hal tersebut terjadi karena LPPOMI mengalami hambatan dalam hal pembinaan dan pengawasan. terhadap makanan halal. yang beredar di Aceh dan tidak adanya peraturan pelaksana Qanun SJPH.
This study aims to explain the handling of cases of immoral crimes whose victims are children in relation to the determination of the court to try and the authority of the investigation carried out by the National Police Investigators and the Aceh Wilayatul Hisbah Investigators associated with the concept of legal protection. The research method used is juridical empirical. Juridical research is using a statutory approach (dass sollen), while empirical research uses a field/interview approach (dass sein). The results of the study show that in Aceh Province in handling immoral crimes in which the perpetrators and victims are children, 2 (two) laws and regulations are applied, namely Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection and Aceh Qanun Number 6 of 2014 concerning Jinayat Law. Qanun jinayat is a positive law which in its application still requires higher legislation with the aim of being guided by the scope of the judiciary so that the ideal concept can be clearly seen in handling cases related to jinayat law. Meanwhile, the Qanun jinayat is a derivative of Law Number 11 of 2006 concerning the Government of Aceh.Keywords: Aceh; Immoral; Disparity. AbstrakPenelitian ini bertujuan untuk menjelaskan penanganan perkara tindak pidana asusila yang korbannya anak kaitannya dengan penentuan pengadilan yang mengadili dan wewenang penyidikan yang dilakukan oleh Penyidik Polri dan Penyidik Wilayatul Hisbah Aceh dikaitkan dengan konsep perlindungan hukum. Adapun metode penelitian yang digunakan bersifat yuridis empiris. Penelitian yuridis adalah menggunakan pendekatan peraturan perundang-undangan (dass sollen), sedangkan penelitian empiris menggunakan pendekatan lapangan/wawancara (dass sein). Hasil penelitian bahwa di Provinsi Aceh dalam penanganan tindak pidana asusila yang pelaku maupun korbannya anak diterapkan 2 (dua) aturan perundang-undangan yaitu Undang-undang Nomor 35 Tahun 2014 tentang Perubahan Atas Undang-undang Nomor 23 Tahun 2002 tentang Perlindungan Anak dan Qanun Aceh Nomor 6 Tahun 2014 tentang Hukum Jinayat. Qanun jinayat merupakan hukum positif yang dalam penerapannya masih memerlukan peraturan perundang-undangan yang lebih tinggi dengan tujuan untuk dipedomani oleh lingkup peradilan sehingga dapat dilihat secara jelas konsep ideal dalam penanganan perkara yang berkaitan dengan hukum jinayat. Sedangkan Qanun jinayat tersebut merupakan turunan dari Undang-undang Nomor 11 Tahun 2006 tentang Pemerintah Aceh.Kata Kunci: Aceh; Asusila; Disparitas.
The aims of this study is to analyze the implementation of empowerment by the Aceh Social Department for people with disabilities and the obstacles in its implementation, in accordance with government regulation No. 52 year 2019 about the welfare accomplishment for people with disabilities.This legal study employs the juridical-empirical method using primary data gathered from interviews and secondary data from literature review as supporting material. Afterward, the data is analyzed using a qualitative approach.The findings showed that the Aceh Social Service based on the Minister of Social Affairs Regulation No. 9 year 2018 concerning Basic Service Technical Standards on a Minimum Service Standardsin the Social Sector in Province and Regency/City only authorized to implement the empowerment for the disabled who were in the orphanage, where, Aceh currently has only one orphanage under Aceh Social Service which available special for the disabled-blind. The obstacles in its implementation are inaccurate data available, limited budget and limited human resources, resulted the empowerment has not implement optimally. A systematic planning and mapping should be done by related party, with the aim, every type of disability can be reached and the efforts can be performed properly, until the independent and the inclusive people with disabilities/disabled groups can be achieved.
