ReSUMoNeste trabalho buscamos analisar, a partir do ordenamento jurídico brasileiro vigente, a possibilidade de se realizarem licitações públicas sustentáveis em todos os níveis da administração pública. Para isso, foram sistematicamente examinadas a Constituição Federal, as Leis nº 8.666/1993 e nº 12.305/2010, bem como o contexto histórico da preocupação mundial
<p>Hoy en día cada vez más personas viven en las grandes ciudades, una población que se está desplazando a barrios cada vez más distantes. Aumenta la distancia entre el centro y la periferia. En esta situación, la movilidad urbana es esencial para garantizar el acceso pleno a la ciudad y al disfrute de los derechos básicos. El objetivo de esta investigación es examinar si la falta de políticas de movilidad urbana restringe el acceso de los ciudadanos a una vivienda adecuada, a partir de un estudio con base en el programa “Mi Casa, Mi Vida” implementado en el barrio Jardim Bassoli, en la ciudad de Campinas, en el estado de São Paulo, Brasil, en el año 2012. Fue utilizado el método hipotético-deductivo con un análisis dogmático-jurídico, teniendo en cuenta análisis de mapas y de documentos nacionales e internacionales. La investigación concluyó que la falta de movilidad urbana en esa región ha causado la limitación del acceso a la vivienda adecuada. La creación de políticas de movilidad urbana sería la forma más viable, rápida y asequible de integrar esta “isla” llamada Jardim Bassoli en la infraestructura de la ciudad.</p>
Esse artigo tem por objetivo explicar o que foi a Segunda Conferência das Nações Unidas sobre Assentamentos Humanos (Habitat II), realizada em 1996, em Istambul, na Turquia, bem como os seus desdobramentos na legislação brasileira pós-1996. Após uma breve exposição a respeito do déficit habitacional brasileiro atual, foi analisado o contexto histórico em que a Habitat II esteve inserida, bem como os eventos preparatórios à Conferência. Posteriormente, foi estudada a Declaração de Istambul (seu documento final), que focou na sustentabilidade social, ambiental e econômica dos assentamentos humanos para conceituar moradia adequada. A partir desse estudo, foi possível analisar, na Parte II deste trabalho, os reflexos dessa Conferência na legislação federal brasileira sobre direito à moradia.
Neste breve artigo estudaremos as esferas de responsabilidade do poluidor que causa dano ambiental, em especial as possíveis responsabilidades da mineradora Samarco pelos danos ambientais resultantes do rompimento da barragem de Fundão e do transbordamento da barragem de Santarém. Para tanto, analisaremos a jurisprudência dos tribunais superiores. O presente estudo busca explicar a possibilidade de o poluidor responder perante esferas distintas pelo mesmo fato, sem isso configurar bis in idem, bem como esclarecer a viabilidade de responsabilidade penal da pessoa jurídica diante da impossibilidade da aplicação de pena privativa de liberdade.
Esse artigo tem por objetivo analisar a legislação federal brasileira sobre direito à moradia, publicada entre 1996 e 2016, verificando se houve influência da Declaração de Istambul, documento final da Segunda Conferência das Nações Unidas sobre Assentamentos Humanos (Habitat II). Após a análise do déficit habitacional brasileiro e do estudo sobre a Habitat II e seu documento final (Parte I), foi realizada uma pesquisa no portal de internet do governo federal (website do Planalto), utilizando os termos ‘moradia’ e ‘habitação’. Dentre as normas filtradas pela pesquisa, 34 normas refletirem princípios e metas da Habitat II, porém somente o Estatuto da Cidade faz referência direta à Conferência.
