A partir de compromissos internacionais assumidos com o Direito dos Refugiados, incorporados pela Constituição Federal de 1988 e pela Lei n. 9.474/97, o Brasil reconhece o direito ao refúgio para as vítimas de violações de direitos humanos, acolhendo em seu solo refugiados das mais diversas nacionalidades. Todavia, o processo administrativo de reconhecimento bem como a integração dos refugiados na sociedade brasileira passa por uma dificuldade crucial: a língua portuguesa. Com o objetivo de analisar as políticas públicas realizadas para solucionar esse impasse, o presente estudo, pelo método hipotético-dedutivo e através de revisão bibliográfica, incluídas pesquisas estatísticas sobre o refúgio no Brasil, concluiu que os cursos de língua portuguesa atualmente ministrados têm cumprido seu objetivo para os poucos refugiados que logram contemplar. Porém, a falta de coordenação e integração entre os programas representa um déficit que compromete a ampliação do seu alcance e mesmo a fiscalização dos resultados.
O direito internacional dos refugiados, pós II Guerra Mundial, fundamentou-se na noção de “direito a ter direitos”, de uma sociedade aberta para a diversidade e o pluralismo, com base na tolerância e na alteridade. Estas concepções estão em xeque com as recentes práticas adotadas pela União Europeia face aos refugiados, notadamente no Acordo União Europeia-Turquia (2016), que prevê a possibilidade de devolução de refugiados aos seus locais de origem, apesar do princípio do non-refoulement. A partir de pesquisa bibliográfica, e pelo método indutivo, o presente artigo busca compreender as implicações filosóficas e éticas da rejeição manifestada pela Europa ao grande contingente de refugiados de origem muçulmana, cuja cultura contrasta profundamente com os valores nutridos pelos povos europeus, a fim de sugerir uma nova compreensão da própria ideia de tolerância enquanto fundamento do Direito Internacional dos Refugiados, e mesmo dos direitos humanos. Conclui-se nesse ensaio que mecanismos burocráticos e jurídicos têm sido utilizados como máscara para a intolerância da Europa frente aos refugiados. Desse modo, a partir de contribuições teóricas de Rorty, Appiah, Heller e Ferénc, percebeu-se que somente a partir da superação da noção abstrata de tolerância, para uma compreensão cosmopolita que reconhece as pessoas em sua concretude histórica e social, bem como pelo alargamento da ideia de “nós” para enfrentar a dicotomia “nós-eles”, que se pode fundamentar o direito de toda pessoa de ser acolhida, quando enfrenta o risco de sua própria aniquilação.
Resumo O sistema interamericano de direitos humanos respondeu a uma insuficiência do direito interno dos Estados latino-americanos em promover e proteger direitos de seus cidadãos. Todavia, as decisões proferidas por seu órgão jurisdicional, a Corte Interamericana, enfrenta graves resistências dos Estados-membros para serem implementadas, notadamente quando determinam responsabilização e punição dos agentes responsáveis pela violação de direitos humanos. A partir das categorias de Pierre Bourdieu, como o campo jurídico e o poder simbólico, procurou-se demonstrar a configuração de um campo social inerente à atuação dos órgãos desse sistema, a fim de investigar a baixa efetividade dessas decisões.Palavras-chave: Corte Interamericana. INTRODUÇÃOA criação de um sistema interamericano destinado à promoção e à proteção dos direitos humanos representa um avanço em relação à valorização ética do ser humano, bem como à limitação do poder soberano dos Estados no tocante à preservação da dignidade humana. Se a América Latina foi palco de severas ditaduras militares no século XX, procura, no século XXI, reconhecer a necessidade de organismos internacionais capacitados para implementar normas internacionais as quais estes Estados livremente aderem. Todavia, se de um lado é inegável o avanço no plano da estruturação de um sistema de proteção, por outro a dificuldade na implementação de suas decisões corresponde a um desafio ainda a ser enfrentado. A Corte Interamericana, na qualidade de autêntico órgão jurisdicional, emite sentenças definitivas que exigem dos Estados obrigações de indenizar vítimas, mas, sobretudo, de prevenir novas violações de direitos humanos e punição dos responsáveis por essas violações. Este artigo tem por objetivo aquilatar o papel da Corte Interamericana de Direitos Humanos na construção do Ius Constitutionale Commune na América Latina, mediante pesquisa bibliográfica doutrinária e jurisprudencial. Para tanto, analisou-se o projeto jurídico de um direito comum formado a partir da interconexão de normas constitucionais e convencionais sobre direitos humanos, a qual fornece uma base jurídica para o constitucionalismo transformador, comprometido em nível nacional e regional com a inclusão social e a realização dos ideais de respeito e promoção da democracia, direitos humanos e Estado de Direito. O desenho institucional que se erige dessa interação tem como pilar diálogos judiciais horizontais e principalmente verticais, em que a Corte Interamericana atua como um vértice canalizador dos sentidos de direitos humanos e impulsionador de sua concretização. Concluiu-se que a Corte, especialmente a partir do diálogo que mantém com cortes nacionais, exerce duas funções primordiais: (i) a harmonização do pluralismo jurídico multinível decorrente da interconexão entre os sistemas constitucionais e o sistema regional, voltada para a construção de standards comuns em direitos humanos; e (ii) o impulsionamento de transformações sociais através de suas sentenças, a fim de tornar efetivos os compromissos constitucionais e convencionais. A partir da compreensão dessas funções, pesquisadores e defensores de direitos humanos têm um campo jurisdicional a explorar a fim de dar continuidade e consistência à realização desses direitos.
