Marriage is a matter advocated by religion. This is because marriage is a encouraging behavior for the realization of Maqashid al-Shariah, precisely Hifdz al-Nasl (keeping the offspring). But the reality is there to be worse when it turns out the marriage ushers humans on conditions that are not better and even worse. The facts on the ground are that many young mothers die after childbirth due to maturation factors of the sexual organs and immature labor, and other social anomalies. Whereas the idealism of marriage is accompanying children and grandchildren to prosper. In psychology studies mentioned that marriages are built not on the basis of emotional maturity susceptible to problems. This fact provides a logical consequence, that the marriage proposal for every youth does not apply to everyone. Married advice is only for young people who have psychological maturity. This is called takhsish bi al-'aqli bi thariqi al-musnahadah. By using this takhsis analysis it can be taken to understand that the advisable youth (الشباب ) married on the content of the hadith is only specific to the adult youth of 25 years. The conclusions of this study are: 1) The meaning of "al-Shabab" in the hadith of marriage recommendation is a certain young man aged 25 years. 2) The category "Istitha'ah" in marriage based on the hadith of marriage recommendation is the ability of marriage financing and psychological maturity.
Seperti masyarakat pada umumnya, masyarakat desa Panempan Pamekasan memiliki pandangan tertentu terhadap pernikahan yang dilaksanakan pada bulan Muharram. Hal ini menjadi analisis dan kesimpulan baru ketika fenomena ini berbenturan dengan perspektif hukum Islam, yang dapat menghadirkan khazanah baru dalam pemikiran budaya keagamaan. (Like society in general, the people of Panempan Pamekasan village have a specific view on marriages held in the month of Muharram becomes a new analysis and conclusion when this phenomenon clashes with the perspective of Islamic law, which can present new treasures in religious, cultural thought.)
There is a unique tradition in the Madurese community of East Java, namely Binsabin and Tongngebban. Both are the absolute requirements for a valid engagement. It means that the engagement is not totally legal without the two things. In the perspective of Islamic law, this is permitted, but from an anthropological perspective, found that there is a social inheritance that is imposed on social bonds, the rules of marriage law and ceremonies in the marriage process. In line with that, this paper wants to describe a local wisdom in a proportional framework, not only seeing society legally, but also society must be seen as a culture (anthropology). This paper is collected from data interviews with two different types of community groups. The results of the study show that first, from an anthropological perspective; the binsabin and tongngebban traditions express the fulfillment of individual psycho-biological needs and maintain the continuity of life of social groups. Anthropology also shows strong the Madurese community is in upholding this tradition from generation to generation even though times round and round. Second, in the perspective of Islamic law, this tradition seeks to build three things, first building a strong agreement between fellow Muslim families, second establishing friendship so as to create a strong emotional bond, third sharing the joy that shown by giving gifts or goods so as to increase the strength of brotherly bonds by religious way (engagement).
