Humans are social creatures, which means that humans like to hang out and live in groups, so that in this relationship the identity of each individual or group facilitates relationships. Not only that, identity has an important role for the continuation of an agreement, with identity, the parties can know and know each other so that the agreement to be agreed is carried out properly. Especially for credit agreements where identity is the main condition that becomes the reference for receiving credit applications. The agreement that has been carried out and reached the agreement is valid as a law for the parties making it, so that in the legal relationship there are rights and obligations to be fulfilled and protected by each other. The purpose of this research is to find out how the legal protection of credit users whose identities are used by others and to find out the legal strength of the agreements that have been agreed by the parties before the credit is granted. This writing is done by examining primary legal materials, secondary legal materials and tertiary legal materials. Based on the results of this writing, a person whose identity has been borrowed to get credit is entitled to his rights according to the provisions of the Consumer Protection Law in article 4 because the owner of the identity is listed as a consumer in a banking institution after the agreement is signed which is legally binding in accordance with Article 1338 of the Criminal Code, if that declare that the agreement is not under pressure or incitement from other parties, so that the agreement does not violate decency, public order and law.Keywords: Legal Protection; Credit Users; Identity.
There is a unique tradition in the Madurese community of East Java, namely Binsabin and Tongngebban. Both are the absolute requirements for a valid engagement. It means that the engagement is not totally legal without the two things. In the perspective of Islamic law, this is permitted, but from an anthropological perspective, found that there is a social inheritance that is imposed on social bonds, the rules of marriage law and ceremonies in the marriage process. In line with that, this paper wants to describe a local wisdom in a proportional framework, not only seeing society legally, but also society must be seen as a culture (anthropology). This paper is collected from data interviews with two different types of community groups. The results of the study show that first, from an anthropological perspective; the binsabin and tongngebban traditions express the fulfillment of individual psycho-biological needs and maintain the continuity of life of social groups. Anthropology also shows strong the Madurese community is in upholding this tradition from generation to generation even though times round and round. Second, in the perspective of Islamic law, this tradition seeks to build three things, first building a strong agreement between fellow Muslim families, second establishing friendship so as to create a strong emotional bond, third sharing the joy that shown by giving gifts or goods so as to increase the strength of brotherly bonds by religious way (engagement).
Penelitian ini bertujuan untuk mengkaji secara normatif standarisasi minuman kemasan yang dapat diperjualbelikan dan langkah hukum untuk menjaga standarisasi minuman kemasan yang diperjualbelikan menurut hukum positif Indonesia.Penelitian ini menggunakan jenis penelitian hukum normatif dengan pendekatan yuridis normatif melalui undang-undang. Data diperoleh dengan menggunakan metode kepustakaan dengan tiga jenis sumber hukum yakni sumber hukum primer berupa undang-undang, sumber hukum sekunder berupa buku-buku, serta sumber hukum tersier berupa kamus. Analisis data menggunakan analisis deskriptif kualitatif. Hasil penelitian menunjukkan bahwa standarisasi minuman kemasan agar dapat diperjualbelikan wajib mencantumkan informasi yang benar pada label, mencantumkan tanggal produksi dan tanggal kedaluwarsa serta informasi tentang bahan tambahan pangan seperti pemanis buatan yang harus dicantumkan secara jelas dalam kemasan agar dapat dipahami dengan baik oleh konsumen demi alasan kesehatan. Langkah hukum untuk menjaga standarisasi minuman kemasan yang diperjualbelikan menurut hukum positif Indonesia yakni dengan penerapan SNI pada minuman kemasan seharusnya diberlakukan secara wajib, mengingat hak konsumen dalam penggunaan suatu produk harus terjamin haknya yaitu mengenai keselamatan, keamanaan, dan kesehatan.
