This paper seeks to understand how decision‐making works at the first appearance hearings (Custody Hearings) in Brazil, an initiative that intends to make the Brazilian criminal justice system more accusatorial. We used primary data gathered in the hearings between April and December 2018 in nine Brazilian states. Binary logistic regression models were applied to identify the variables that affect the odds ratios of pretrial detention. Results indicated a high level of homology between the prosecutors' requests and the judges' decisions, even when controlling for the characteristics of offense and offender, which precludes any direct openness to the defense. Decision‐making in the Custody Hearing reinforces the inquisitorial characteristics and the institutional features of the Brazilian Criminal Justice System, suggesting that the reforms carried out over the last years were not able to change how actors operate on a daily basis.

Conflitos entre policiais e operadores da justiça são recorrentes nos estudos sobre o sistema de justiça criminal. Por outro lado, não são raras as pesquisas que mostram como uma instituição tende a ratificar o trabalho da outra. Realizamos uma revisão bibliográfica dos artigos publicados no Brasil nos últimos dez anos (2011-2021) que abordam as relações entre esses dois atores. Neste texto, buscamos compreender: 1) como essa relação tem sido explorada nos trabalhos acadêmicos; 2) as bases dos conflitos e como eles se reproduzem nas percepções e nas práticas cotidianas do sistema de justiça; e 3) se as inovações implementadas nesse período impactaram essa relação.Conflicts between police officers and justice workers are recurrent in studies on the Brazilian criminal justice system. On the other hand, studies that point out that one institution tends to ratify the work of another are also not rare. In Conflicts and Confluences between the Police and the Judiciary in Studies Published between 2011 and 2021 we carried out a literature review of the papers published in Brazil in the last ten years (2011)(2012)(2013)(2014)(2015)(2016)(2017)(2018)(2019)(2020)(2021) which address the relationships between these two actors. In this text, we seek to comprehend: 1) how this relationship has been explored; 2) the basis of these conflicts and how they take place in the system and in the daily practices of these organizations; and 3) whether innovations implemented during this period have affected this relationship. A tese examina as atitudes do público a respeito do uso da força excessiva pela polícia. Nosso pressuposto é que as práticas arbitrárias e o emprego de métodos violentos e abusivos que marcam historicamente a atuação das forças policiais brasileiras não poderiam ser um fenômeno tão persistente sem a existência de algum respaldo por parte da sociedade para a manutenção de tais ações. Nesse sentido, investigamos não só a magnitude desse apoio, mas principalmente, quais são as explicações que podem ser acionadas para melhor compreender o respaldo conferido para a polícia agir de maneira violenta. Com base em um estudo empírico, conduzido por meio de dados de um survey aplicado a 1.806 moradores da cidade de São Paulo em 2018, verificamos que efeitos as variáveis sociodemográficas, contextuais e atitudinais exercem sobre a disposição de apoiar o uso da força excessiva por parte da polícia. Nossos dados indicam que o apoio ao uso da força excessiva pela polícia é mais acentuado dentre os brancos, os homens e pessoas com maior adesão à valores autoritários, e não se mostrou relacionado com medo do crime e percepção de vulnerabilidade ao crime. Os resultados apontam que, para uma parcela dos entrevistados, o apoio a ações excessivas da polícia está ligado à uma concepção autoritária do exercício de poder.
