Dispute settlement of Industrial Relations through mediation stipulated in article 8 of the Actadalah penyelesaian yang dibantu oleh seorang mediator yang berasal dari pegawai dibidang ketenagakerjaan. Kemudian Pasal 9, mengatur syarat-syarat menjadi mediator. Kedua pasal ini sangat diskriminatif. Mediator seorang Pegawai Negeri Sipil (PNS) yang harus tunduk juga kepada Undang-undang Kepegawaian. Mediator sebagai seorang pegawai negeri sipil tentu mempunyai atasan maupun bawahan sesuai hierarkhi jabatannya, hal ini tidak menutup kemunkinan adanya intervensi dari atasan, sehingga akan mengganggu mediator dalam melaksanakan tugasnya, dan independent mediator tidak terwujud. Orang yang akan menjadi mediator dapat saja diperluas selain Pegawai Negeri Sipil dibidang ketenagakerjaan, diantaranya advokat, dosen, komnas HAM, mediator lain yang dianggap mampu dan netral. Hal ini juga merupakan salah satu solusi bagi pemerintah untuk mengatasi kekurangan mediator di Indonesia.Kata kunci: mediasi, mediator, reformasi hukum PendahuluanManusia sebagai mahkluk sosial (zoon politicon) mempunyai kebutuhan yang beraneka ragam, yang diantaranya adalah sandang, papan, pangan. A notary is a public official authorized to draw up and keep authentic deeds and other documents permitted by laws and regulations. Whenever a notary dies, or reaches retirement age, changes his/her domicile or profession, he/she shall submit his/her retired notary protocol to another notary appointed by the Regional Supervisory Council. The submission of notary protocol is regulated in Article 65 of the Law on Notary Positions, yet without legal protection. In some cases, court decisions are found to have imposed sanctions upon a notary who received the protocol despite the mistake of the notary protocol giver. This article encourages that the notary who receives the protocol be provided with legal protection, because he/she is only the party who receives the protocol made by another notary. The imposition of responsibility upon the notary protocol recipient regarding the contents of the deed he/she keeps will only lead to injustice and legal uncertainty. Since no regulation has been provided concerning to such matter, it is necessary to afford legal protection which comprises: the responsibility of the heirs of the notary (giver); the limitation of the responsibility of the protocol recipient; the limitation of protocol retention time; and the necessity of storing notary protocols in the form of microfilm. Nevertheless, the notary protocol recipient shall also have limited protection, in the sense that he/she can be held accountable with respect to the obligation to keep the notary protocol he/she receives in proper ways. Abstrak Notaris adalah pejabat umum yang berwenang membuat dan menyimpan akta dalam bentuk akta otentik, serta dokumen lain yang diperbolehkan oleh perundang-undangan. Setiap notaris yang meninggal dunia, mencapai usia pensiun, pindah domisili, atau pindah profesi, wajib menyerahkan protokol notarisnya kepada notaris lain yang ditunjuk oleh Majelis Pengawas Daerah. Pengaturan penyerahan protokol notaris diatur dalam Pasal 65 Undang-undang Jabatan Notaris, namun tidak dengan perlindungan hukumnya. Dalam beberapa kasus dijumpai putusan pengadilan yang memberikan sanksi kepada notaris penerima protokol sekalipun berkaitan dengan kesalahan notaris pemberi protokol. Artikel ini mendorong agar notaris penerima protokol mendapatkan perlindungan hukum, sebab ia hanya sebagai pihak yang menerima protokol yang dibuat oleh notaris lainnya. Pembebanan tanggung jawab kepada notaris penerima protokol terkait isi akta yang disimpannya justru akan menyebabkan ketidakadilan dan ketidakpastian hukum. Oleh karena sejauh ini belum ada pengaturannya, maka perlu diupayakan perlindungan hukum yang meliputi: tanggung jawab ahli waris notaris (pemberi); batasan tanggung jawab penerima protokol; batasan waktu penyimpanan protokol; dan keharusan penyimpanan protokol notaris dalam bentuk mikrofilm. Meski demikian, notaris penerima protokol tentu harus pula dibatasi perlindungannya, dalam artian dapat dimintai pertanggungjawabannya, yaitu dalam hal keharusannya menyimpan protokol notaris yang diterimanya secara patut.
This study aims to identify and analyze the implementation of social responsibility and the constraints faced by coal mining companies through community development and empowerment programs at PT. Jambi Prima Coal. As for the formulation of the problem to be discussed in this study, namely : (1) How is the implementation of social responsibility for coal mining companies through community development and empowerment programs at PT. Jambi Prima Coal?. (2) What are the obstacles faced in implementing the social responsibility of coal mining companies through the community empowerment development program at PT. Jambi Prima Coal?. The research method used in this research is juridical empirical. From the research results it can be concluded that: (1) The implementation of social responsibility for coal mining companies through development and empowerment programs by PT Jambi Prima Coal has not been implemented properly, resulting in the budget as contained in the RKAB is not properly absorbed. (2) The obstacles faced occur due to lack of communication from various parties, including: PT. Jambi Prima Coal, Ministry of Energy and Mineral Resources, and the community. The settlement efforts made by PT. Jambi Prima Coal, namely through the need assessment to the local community. Abstrak Penelitian ini bertujuan untuk mengetahui dan menganalisis pelaksanaan tanggung jawab sosial serta kendala-kendala yang dihadapi perusahaan pertambangan batubara melalui program pengembangan dan pemberdayaan masyarakat di PT. Jambi Prima Coal. Adapun rumusan masalah yang akan dibahas dalam penelitian ini yaitu: (1) Bagaimana pelaksanaan tanggung jawab sosial perusahaan pertambangan batubara melalui program pengembangan dan pemberdayaan masyarakat di PT. Jambi Prima Coal ?, (2) Apa kendala-kendala yang dihadapi dalam pelaksanaan tanggung jawab sosial perusahaan pertambangan batubara melalui program pengembangan pemberdayaan masyarakat di PT. Jambi Prima Coal ?. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis empiris. Dari hasil penelitian dapat dikemukakan bahwa: (1) Kelaksanaan tanggung jawab sosial perusahaan pertambangan batubara melalui program pengembangan dan pemberdayaan oleh PT Jambi Prima Coal belum terlaksana sebagaimana mestinya, sehingga mengakibatkan anggaran biaya sebagaimana termuat dalam RKAB tidak terserap dengan baik.(2) Kendala yang dihadapi terjadi karena kurangnya komunikasi dari berbagai pihak, diantaranya: PT. Jambi Prima Coal, Kementerian ESDM, dan masyarakat. Adapun upaya penyelesaian yang dilakukan oleh PT. Jambi Prima Coal yaitu melalui need assesment (analisis kebutuhan) kepada masyarakat setempat.
Sanction about violations that commited by Notary are regulated in Notary position regulation and ethics code of Notary. But, there is no further explanation regarding the form of violations such as what can be said as a minor violation to a serious violation in the imposition of a Notary sanction cause the ambiguity of norms in Article 9 paragraph (1) letter d regarding Notary violations and Article 12 letter d regarding gross violations by Notary. The purpose of this study is to find out and analyze the arrangements of sanctions imposition for gross violations committed by Notary and Notary legal efforts that are sanctioned for gross violations in the perspective of laws and regulations by using the type of normative juridical law research. To determine the types of violations or classification of notary violations, based on the review and policy of the Notary Supervisory Assembly as an authorized official with reference to applicable laws and regulations because there is no further explanation of the classification of notary violations. If the Notary feels the objection to being sanctioned for gross violations, then the Notary can file a legal effort that is to file a lawsuit with the State Administrative Court.
