The Judiciary against Political Corruption in Spain, France and Italy.
In Spain, France and Italy, political leaders are increasingly sued in relation to cases of « political corruption ». This trend has triggered off a profound change in mentalities regarding the traditional role of the judiciary in the maintenance of the democratic balance of power. This shift bears witness to the changes in the ethics of a profession in the midst of mutation. Comparing the way in which cases are handled in the three countries brings to light the more limited institutional autonomy of the French and Spanish judges as compared to their Italian counterparts. Generally speaking, the intrusion of judges into the political sphere and media strategies tend to imperil their impartiality and, as the Italian case shows, may eventually challenge their legitimacy.
