AbstrakDari 3 (tiga) pilar industri keuangan, bank memiliki peran yang lebih penting. Goncangan terhadap bank, akan menimbulkan dampak yang signifikan terhadap perekonomian nasional. Sekalipun Indonesia memiliki kesejarahan pengaturan penjaminan nasabah bank sejak tahun 1973, akan tetapi perhatian secara serius baru diberikan sejak tahun 1998 ketika Indonesia mengalami krisis moneter. Penelitian ini difokuskan pada optik kesejarahan lembaga penjaminan simpanan nasabah di Indonesia. Penelitian normatif dengan pendekatan kesejarahan dan dipadukan pendekatan perbandingan, menghasilkan simpulan bahwa perkembangan lembaga penjaminan nasabah bank dapat dipilah menjadi 3 (tiga) periode yang masing-masing menggunakan pola blanket guarantee dan limited deposit insurance. Perbandingan dengan Singapore of Deposit Insurance Company (SDIC) menghasilkan lesson learning perlunya Indonesia mengembangkan penjaminan yang mencakup Industri Keuangan Bukan Bank dan menerapkan sistem agregat. AbstractAmong the 3 (three) pillars of the financial industry, banks have a very important role. The bank instability is believed to deliver a significant impact on the national economy. Even though Indonesia started to regulate bank customer guarantees since 1973, the real concern of the matter came up in 1998 when Indonesia was experiencing a monetary crisis. This study focuses on the historical optics of customer deposit guarantee institutions in Indonesia. This normative research is combined with the approaches of historical and comparative. The research concludes that the development of bank customer guarantee institutions can be divided into 3 (three) periods which each period applies the patterns of a blanket guarantee and limited deposit insurance. A comparison with Singapore of Deposit Insurance Company (SDIC) was conducted and it created a lesson learning, that Indonesia needs to develop the guarantees which include Non-bank Financial Institusions and it needs to implement an aggregate systems.
Tata kelola koperasi yang tidak berbasis pada prinsip good cooperative governance berpotensi rmemunculkan dampak buruk bagi kesehatan koperasi dan kelangsungan pengembangan bagi koperasi yang seharusnya dipumpunkan pada upaya untuk mensejahterakan anggota. Kajian penelitian dilakukan dengan pendekatan juridis sosiologis. Hasil penelitian ini diharapkan memberikan kontribusi dalam merefleksi penatakelolaan koperasi di Kota Salatiga. Tatakelola Koperasi adalah kerangka kerja (framework) dalam bentuk peran (role), aturan (rule) dan pola keterhubungan (relationship) dari organ-organ Koperasi beserta dengan turunannya dalam mengarahkan dan mengendalikan usaha, untuk mewujudkan maksud dan tujuan Koperasi. Good coorporative governance didorong dari dua sisi, yaitu etika dan peraturan.
Dunia Bisnis terpapar oleh pandemi Covid-19. Bagi pengusaha yang memiliki kewajiban membayar hutang, dapat dimohonkan pailit yang pada umumnya akan mengakibatkan terhentinya kegiatan usaha. Untuk menghindari kebangkrutan, debitur dapat mencari formula lain sebagai jalan keluar dari masalah itu. Tujuan penelitian ini adalah untuk mengeksplorasi (kemungkinan) pemanfaatan PKPU dalam masa Covid-19, termasuk kelemahan yang dihadapi oleh pelaku usaha. Penelitian ini adalah penelitian hukum yuridis normatif, dengan pendekatan filosofis dan pendekatan konseptual. Temuan penelitian ini adalah bahwa titik penghubung antara PKPU dan kepailitan menjadi solusi namun mengandung potensi jebakan yang dapat berakibat fatal bagi debitur. Oleh karena itu, debitur harus cermat dalam memilih pola penyelesaian utang yang memiliki risiko paling kecil. Restrukturisasi kredit atau pembiayaan memiliki risiko rendah bagi debitur, sedang PKPU lebih baik diposisikan sebagai pilihan terakhir.
The relationship between employers and workers tends to be characterized by a tension between the employers' and workers' interests. While the employers maintain business continuity to obtain optimal advantages, the workers demand to get decent wages or welfare. For example, the laborers have struggled through a constitutional way by submitting a judicial review of Law No. 13 of 2003 concerning Manpower. This research used a conceptual approach and a philosophical approach to observe the relevant legal material in the Constitutional Court's decision to obtain legal guarantees with more legal certainty. In conclusion, this research found that: (a) The phrase 'for the sake of the law' should have granted the laborers more legal protection. However, it still creates multiple interpretations that lead to the loss of certain legal protections. (b) The Constitutional Court, through its decision, has laid the basis of legality with more legal certainty through the implementation of labor protection norms gradually. (c) Even though the Constitutional Court's decision has already provided legal certainty normatively, the uncertainty of legal protection still exists in practices.
This research revealed the shift of political law as a result of implementation Act of Republic of Indonesia No.17 of 2012 that reposition Act of Republic of Indonesia No.25of 1992. The implementation of Act of Republic of Indonesia No.17 of 2012 leaved crusial problem because of the lack of values ethic of cooperative. The crucial problems in Act of Republic of Indonesia No.17of 2012 related with the reduce of cooperative concept by limited as a legal entity. Beside that, the capital aspect has potential to reduce the value of cooperative, the appointment of cooperative management of non members, and the power of supervisory board of cooperatice, and the distribution of surplus operating results . The constitutional court with erga omnes character canceled act of Republic of Indonesia No.17 of 2012 and maked transtitional to re implement Act of Republic of Indonesia No 25 of 1992 as a focus in this research.
