RESUMO: O presente artigo tem como objeto de estudo o uso de símbolos religiosos nos espaços públicos, à luz da jurisprudência da Corte Europeia de Direitos Humanos. ResumoA partir da escolástica de Francisco de Vitória, analisa-se em que medida o poder-domínio, baseado nos preceitos éticos da lei natural, legitima a soberania na República e origina o jus gentium, base dos princípios jurídicos do Direito Internacional Público. Conceitua-se o domínio civil com a fundamentação do poder civil na razão natural. Delimita-se a função da autoridade na República e explora-se a natureza do direito e o objetivo da soberania com base na finalidade Estatal no bem comum. Objetiva-se entender a necessidade do summa potestas da comunidade e a lei positiva serem orientados pelo direito natural e pela justiça. Dos argumentos sobre a guerra justa, extraem-se os princípios da “proporcionalidade dos meios”, da “solução pacífica de controvérsias” e da “intervenção humanitária” em violações de crimes contra a humanidade. Justifica-se a necessidade da orbe formar uma República, para que se obrigue as autoridades soberanas em respeitar leis justas e o jus gentium. A pesquisa é bibliográfica qualitativa, com análise doutrinária da escolástica de Francisco de Vitória. Conclui-se que o poder, baseado nos preceitos éticos da lei natural, intitula o homem como sujeito de direitos subjetivos, afirmando a dignidade da pessoa humana, inaugurando os fundamentos dos princípios jurídicos do Direito Internacional Público.Palavras-chave: Direito Internacional; Francisco de Vitória; guerra justa; jus gentium; soberania.AbstractBased on Francisco de Vitória's scholasticism, it´s analyzed the extent to which power-dominance, based on the ethical precepts of natural law, legitimizes sovereignty in the Republic and originates the jus gentium, the basis of the legal principles of public international law. The civil domain is conceptualized with the foundation of civil power in natural reason. The role of authority in the Republic is delimited and the nature of law and the objective of sovereignty are explored based on the State's purpose in the common good. The objective is to understand the need for summa potestas of the community and positive law to be guided by natural law and justice. It is demonstrated the principles of “proportionality of means”, “peaceful settlement of disputes” and “humanitarian intervention” in violations of crimes against humanity. The need for the orb to form a Republic is justified, so that the sovereign authorities are obliged to respect just laws and the jus gentium. The research is qualitative bibliographic, with doctrinal analysis of the scholastic of Francisco de Vitória. It is concluded that power, based on the ethical precepts of natural law, entitles man as a subject of subjective rights, inaugurating the foundations of the legal principles of International Public Law.Keywords: International Law; Francisco de Vitória; just war; jus gentium; sovereignty.
ResumoEste artigo tem por objetivo aproximar as noções de florescimento humano – conforme a Teoria Neoclássica da Lei Natural – e expansão da vida – conforme a biopolítica afirmativa de Roberto Esposito. Para verificar a possibilidade de aproximação foi levantada a hipótese segundo a qual a noção de bem comum pode preencher a lacuna deixada na compreensão do munus comunitário. A explicação conceitual e aproximação são feitas em três seções. Este é um debate conceitual elaborado a partir de John Finnis (2007; 2011b) e Roberto Esposito (2008; 2003; 2005) e levado a cabo nesta pesquisa por meio da revisão bibliográfica.Palavras-chave: Teoria Neoclássica da Lei Natural; Biopolítica; Bem Comum; John Finnis; Roberto Esposito. AbstractThis article aims to approximate the views of human flourishing – according to the Neoclassical Natural Law Theory– and expansion of life – according to Roberto Esposito's affirmative biopolitics. In order to verify the possibility of an approximation, the hypothesis conceived was that the notion of the common good can fill the gap left in the understanding of the munus of the community. The conceptual explanation and approximation are made in three sections. This is a conceptual debate elaborated from some works of John Finnis (2007; 2011b) and Roberto Esposito’s (2008; 2003; 2005) and realized in this article through the technique of bibliographic revision.Keywords: Neoclassical Natural Law Theory; Biopolitics; Common Good; John Finnis; Roberto Esposito.
Este artigo aborda a importância do processo estruturante para o alcance da igualdade formal, em um caminho para o desenvolvimento. Ao longo deste trabalho, a partir da metodologia de pesquisa bibliográfica, foi possível identificar o processo civil de interesse público com a tutela de direitos coletivos. A percepção do processo como instrumento de concretização de valores constitucionais, somadas à judicialização e ao ativismo judicial foram identificadas como premissas essenciais ao desenvolvimento do tema. A nova compreensão das funções processuais, com o incremento de técnicas de participação democrática por meio do processo de cooperação e diálogo foram essenciais ao próprio desenvolvimento das premissas acima elencadas, culminando com o atual momento vivenciado, em busca da efetividade processual. Compreendeu-se a inadequação do modelo individualista deprocesso frente aos novos direitos, ligados aos valores constitucionais e de proteção das coletividades, e à sociedade contemporânea.
