o presente artigo pretende analisar políticas públicas como instrumentos para garantir os direitos fundamentais, especialmente o direito social fundamental à saúde. Busca-se, inicialmente, a compreensão do conteúdo do direito à saúde diante da necessidade de uma interpretação ampliativa. Depois, analisa-se a relevância jurídica das políticas públicas para garantia desse direito no Brasil, com ênfase no Sistema Único de Saúde – SUS. A ineficácia dessas políticas gera uma crescente judicialização do direito à saúde, que não se mostra a solução mais adequada para concretização desse direito, impondo alternativas para além das demandas judiciais.
A proposta de financiamento público exclusivo é um dos pilares da reforma política que tramita perante o Congresso Nacional sob a justificativa que garantirá a observância da igualdade entre os partidos políticos que pleiteiam vagas nas casas legislativas das unidades federativas, assim como impedir a existência de caixa 2 e outras transgressões não apena à legislação eleitoral, mas, essencialmente, ao Estado Democrático de Direito. Ocorre que o financiamento público exclusivo de campanhas eleitorais não se apresenta, sequer de longe, a melhor saída para a efetivação e observância dos pilares de democracia que sustentam o Estado brasileiro, dentre outros fatores, porque não se propõe a estabelecer um tratamento que torne capaz a legítima disputa eleitoral, de modo a possibilitar a ascensão de partidos políticos com menor representatividade ou nenhuma e, principalmente, por se apresentar como uma negativa ao princípio da maioria visto ser um instrumento de perpetuação das maiorias, nessa condição, impedindo, portanto, o crescimento e o desenvolvimento do debate que deve preceder toda e qualquer produção legislativa.
O controle de constitucionalidade das normas é utilizado para retirar do sistema jurídico as normas incompatíveis com a ordem estabelecida pela Constituição Federal, bem como é fundamental para o equilíbrio do Estado Democrático de Direito, a partir da proteção do equilíbrio das funções desse Estado e por garantir a observância dos direitos previstos no plano constitucional, motivos pelos quais (dentre outros) deve ser considerado também como um dos pilares do Estado Democrático de Direito. No modelo brasileiro da Ação Direta de Inconstitucionalidade é permitida a concessão de medidas cautelares, com o desiderato de declarar, provisoriamente, a inconstitucionalidade das normas que, aprovadas por um processo democrático de deliberação, deveriam ter sobre si presunção moderada de constitucionalidade, o que, de per si, não autorizaria o juiz a considerar cautelarmente a incompatibilidade do documento normativo ao texto constitucional, de acordo com o que preleciona Víctor Comella. Diante desse contexto, a concessão de cautelares em sede da Ação Direta de Inconstitucionalidade deveria ser considerada incompatível com os fundamentos constitucionais do Estado brasileiro.
