Artigo que problematiza acerca da responsabilidade do Estado na garantia do direito à saúde à luz da teoria de justiça de John Rawls. Analisa-se, inicialmente, o direito à saúde, sua caracterização e tratamento constitucional. Depois, trata-se da política pública do SUS, bem como de alguns argumentos que negam a garantia do direito à saúde nos moldes concebidos pelo Constituinte. Por fim, com base na teoria de justiça como equidade de John Rawls, delineada na obra Uma teoria da Justiça, suscita-se reflexão envolvendo a responsabilidade do Estado na garantia do direito fundamental social à saúde.
o presente artigo pretende analisar políticas públicas como instrumentos para garantir os direitos fundamentais, especialmente o direito social fundamental à saúde. Busca-se, inicialmente, a compreensão do conteúdo do direito à saúde diante da necessidade de uma interpretação ampliativa. Depois, analisa-se a relevância jurídica das políticas públicas para garantia desse direito no Brasil, com ênfase no Sistema Único de Saúde – SUS. A ineficácia dessas políticas gera uma crescente judicialização do direito à saúde, que não se mostra a solução mais adequada para concretização desse direito, impondo alternativas para além das demandas judiciais.
O presente artigo visa a apresentar e a comparar duas distintas teorias da justiça, a teoria da justiça como equidade de John Rawls e a teoria da justiça focada nas realizações de Amartya Sen, de modo a destacar suas afinidades e divergências. Inicialmente, apresenta-se a teoria de Rawls, mais especificamente delineada na obra Uma Teoria da Justiça. Em seguida, aborda-se a concepç ão de Sen em relação à justiça social centrada em realizações. E, por fim, são apresentadas as críticas de Sen a Rawls em uma abordagem comparativa entre as teorias.
RESUMOArtigo que pretende discutir, a partir da evolução dos conceitos de família e filiação, o valor jurídico do afeto. Para tanto, traçaremos um paralelo entre a paternidade biológica, restrita a uma concepção de genética e a paternidade socioafetiva, que retrata a subjetividade dos laços estabelecidos por meio dos nobres sentimentos do amor, carinho, cuidado, dentre outros, para mostrar que o direito vem atribuindo maior valor às relações afetivas quando em conflito com a relação estritamente biológica.

Abstract/Resumen/RésuméArticle aims to discuss, from the evolution of the concepts of family and membership, the legal value of affection. Therefore, we will draw a parallel between biological paternity, restricted to a conception of genetic and socio-affective paternity, which depicts the subjectivity of the links established by the noble feelings of love, affection, care, among others, to show that the right comes assigning greater value the personal relationships when in conflict with the strictly biological relationship.
