O presente artigo traça uma análise da perda alargada à luz da Teoria Econômica do Crime. Para tanto, parte-se da exposição acerca dessa teoria e de seus principais fundamentos; apresentam-se as principais nuances dogmáticas da perda alargada, instituto de Direito Penal que expande as fronteiras dos tradicionais instrumentos de confisco; e aplica-se a Teoria Econômica do Crime à perda alargada. O problema consiste em identificar, através do método dedutivo, se a perda alargada efetivamente aumenta de modo significativo os custos esperados pelos potenciais agentes criminosos. Ao final, a hipótese inicialmente lançada – que apresenta resposta afirmativa àquela indagação – é verificada.
O presente artigo trata da prescrição no âmbito do Processo Administrativo Disciplinar. Para tanto, apresenta-se o tratamento dado à matéria pela Lei 8.112/90, destacando-se a problemática em torno do marco inicial para a contagem do prazo prescricional e da referência à utilização dos prazos prescricionais definidos pela lei penal. O problema da pesquisa consiste em identificar se a interpretação da CGU no sentido de que a contagem do prazo prescricional deve iniciar da ciência da autoridade competente para instauração do PAD conforma-se ao Estado de Direito. Utilizando-se método hermenêutico, verifica-se a hipótese inicialmente levantada que dá resposta negativa ao problema.
Após remissão à responsabilidade civil no Brasil e à exposição de dados de acesso à justiça, o artigo sugere a existência de efetiva “indústria” da inércia do consumidor, representada pelo incentivo à continuidade de violações a direitos, dada a previsibilidade de decisões judiciais, a mitigação do dano moral, além das variáveis do acesso à justiça. O artigo embasa-se na Análise Econômica do Direito (AED), para a tomada de decisões jurídico-econômicas que desincentivem tal “indústria”. Trata-se de pesquisa bibliográfica e documental para a exposição da teoria e dos dados levantados, utilizando o método qualitativo e a análise explicativa.
