O objetivo deste trabalho é analisar a justiça ambiental e o direito fundamental ao meio ambiente como forma de garantir e realizar o mínimo existencial à luz da con-cepção de justiça de John Rawls. A partir de uma abordagem analítica, desenvolve-se a tese de que o direito fundamental ao meio ambiente se agrega ao rol de direitos fundamentais, argumentando que o mínimo existencial ecológico pode ser susten-tado como corolário da dignidade da pessoa humana. Parte-se da teoria rawlsiana de justiça para fundamentar a tutela ao meio ambiente, objeto de proteção e tutela jurídica, em virtude de ser a condição da própria existência e da efetivação dos de-mais direitos humanos. Por fim, sustenta-se que a proteção do mínimo existencial ecológico para todos os indivíduos estaria em conformidade com os pressupostos de um Estado Socioambiental e, em última análise, que se trata de uma das formas da realização de uma teoria da justiça.

* Paulo César NodariResumo: A ciência e a tecnologia ocupam um lugar fundamental e insubstituível na construção da realidade sociocultural atual. Elas estão ligadas ao destino da vida humana, sendo que o ser do homem está marcado cada vez mais pela ciência e a depender dela em e para a sua efetivação. Diante da percepção de que o progresso científico-tecnológico avança muito mais rapidamente que o raciocínio ético da ação, constata-se, pois, certo descompasso entre os avanços científico-tecnológicos e o alcance da reflexão e da práxis do agir ético, sobretudo, depois que a ciência e a técnica ampliaram a margem de liberdade e autonomia. À luz dessa constatação, objetiva-se neste artigo remontar à Fundamentação da metafísica dos costumes de Kant na segunda formulação do imperativo categórico, humanidade como fim, com a finalidade de investigar se a mesma, por um lado, pode ser aproximada à compreensão do fim último e do fim terminal no processo de moralização na Crítica do juízo, e, por outro lado, se a concepção de humanidade e dignidade em Kant ainda pode ser ancoradouro razoável e seguro à discussão ética contemporânea de espectro eminentemente científico.Palavras-chave: Kant.
