O médico residente, por ser profissional já graduado, responde a ações de responsabilidade civil em conformidade à legislação civilista ou consumerista de acordo com o âmbito do serviço prestado, se público ou privado, respectivamente. Este trabalho levantou a jurisprudência do Tribunal de Justiça de São Paulo em que residentes atuaram no polo passivo de lides sobre erro médico no estado de São Paulo, entre janeiro de 1998 e dezembro de 2016. As decisões indicaram que nas ações em que o residente respondeu com superiores hierárquicos acadêmicos eles não tiveram sua culpa apreciada e, sim, a dos seus supervisores, exceto em casos de erro grosseiro. Quando participaram do feito junto à equipe do hospital, sem que houvesse vinculação acadêmica, foram condenados em todas as ações, mediante verificação de culpa pessoal sobre o dano. Nas lides em que responderam sozinhos apenas com o hospital, foram condenados em apenas 2 casos (14,3%). Muito embora várias das instituições privadas que compuseram a amostra fossem prestadoras de serviço público, tanto seus médicos quanto os residentes não deveriam ter participado das lides por terem atuado como agentes públicos, porém a ilegitimidade não foi suscitada nas ações tempestivamente. O dever do médico de prover informação aos pacientes mereceu destaque nos acórdãos, já que a conduta esclarece quais procedimentos serão realizados e seus possíveis efeitos adversos. A falta de documentação neste sentido pode suscitar o entendimento de que houve dano indenizável pelos magistrados.
<p>Em 2012, foi aprovada a legalização do término de gestações de fetos anencéfalos no Brasil pelo Supremo Tribunal Federal (STF). Contudo, os tribunais brasileiros já vinham se posicionando neste sentido por vários anos, com destaque a atuação dos tribunais paulistas. O objetivo deste trabalho foi buscar o posicionamento e as justificativas que serviram de apoio às decisões referentes à interrupção das gestações de anencéfalos e observar na literatura dados referentes aos aspectos médico-legais envolvidos nas decisões. Em São Paulo, foram encontrados 30 acórdãos relacionados ao tema interrupção de gestação de anencéfalos, 9 favoráveis, 6 contrários ao aborto e 15 que não tratavam diretamente o tema. Quando autorizado, o aborto foi realizado tendo como fundamentação jurídica: a) analogia com o aborto terapêutico ou com o sentimental; b) o direito à vida, à saúde, à intimidade, à dignidade e autonomia da gestante; c) a inexigibilidade de conduta diversa da gestante; e d) a equiparação do feto anencéfalo ao morto cerebral. Já os negados, consideraram a primazia do direito à vida do nascituro e a ilegalidade da conduta. Do ponto de vista legal, além dos artigos referentes ao aborto encontrados no Código Penal, foram citados os direitos fundamentais encontrados na Constituição Federal (1988), a Lei no 9.434/97, Lei no 8.069/90, a Declaração Universal dos Direitos Humanos (1948), Declaração Universal dos Direitos da Criança (1959), as resoluções do Conselho Federal de Medicina - CFM nos 1.480/97 e 1.752/04, o Pacto de São José (Decreto no 678/92), e a Arguição de Descumprimento de Preceito Fundamental - ADPF no 54 (2008).</p>
Brazilian physicians and judges frequently have to decide whether to save the life of a Jehovah Witness patient that refuses blood transfusion or let the patient die when treatment refusal reflects their religious belief. The Penal Code condemns the physician who fails to use all the available means to save the patient. The Civil Code, contrarily, requires the professional to respect the patient’s autonomy regarding their decision over an intervention with potential risk of death. The Brazilian Constitution guarantees religious freedom and the inviolability of the right to life. This article reviews the Brazilian jurisprudence on the matter through recovery of all available decisions in the Federal and State Courts’ online database up to 2013. The results show that these superior courts consider that people are not allowed to let go of their own lives for religious reasons when in a state of “imminent death”. However, when the patient’s clinical state is qualified as “at risk of dying”, physicians are requested to respect their dissent.
This work aimed to research medical records' legal and regulatory definitions as found in force not only in the Brazilian normative systems but also at the Federal and Regional Councils of Medicine (Conselho Federal e Conselhos Regionais de Medicina), particularly their completeness to be accepted by the judicious system. This empirical retrospective documentary research recovered norms, legislations, resolutions, and professional opinions about medical records and some of its parameters, such as content, legibility, and accountability using official legal and regulatory digital platforms. No period limitation was set for document recovery; however, only current ones (still in force) were analyzed in full. Documents that dealt with the content of the medical record per se were included; those that dealt with custody, confidentiality, digitization, and access to third parties were excluded. The Brazilian legislation does not provide a clear definition of medical records or their core content. Nonetheless, its collective nature is recognized. The Federal and Regional Councils of Medicine have issued numerous resolutions and opinions on the matter, clarifying its completeness in nature. Medical Records are a collection of health documents of a patient, which should be readily available upon court request as a complete medical dossier, and must contain legible and signed copies, including all the procedures a person underwent while under care.

As jurisprudências abrangeram, em sua maioria, casos de reabilitação oral, implantes e ortodontia. A documentação odontológica mostrou-se fundamental para a proposição das ações pelos profissionais, sendo que a falta de indicação de participação do paciente nos registros imprimiram fragilidade na alegação do profissional em juízo. O tempo para prescrição das ações desta natureza sofreu alteração com a vigência do novo Código Civil, sendo hoje de 5 anos. Ainda foi observado o entendimento da reabilitação protética como uma atividade com finalidade estética e não reabilitadora funcional, limitada por fatores biológicos. Falhas básicas como a celebração de contratos com menores e falta de orientação quanto a orçamentos multidisciplinares também foram encontradas.</span></span></span></span></span>
