Welche Faktoren entscheiden über das Ausmaß der legislativen Parteienfragmentierung in den deutschen Bundesländern? Während die Vertreter des institutionellen Ansatzes auf die Bedeutung der Ausgestaltung des Wahlrechts verweisen, werden in der soziologischen Theorie der Grad der gesellschaftlichen Heterogenität und die daraus entstehenden Konfliktlinien als bestimmend angesehen. Im vorliegenden Beitrag werden aus beiden Theorien Hypothesen abgeleitet und anhand einer Aggregatdatenanalyse getestet. Es zeigt sich, dass die konfessionelle Heterogenität den größ-ten Einfluss auf die Zersplitterung der Parteienlandschaft ausübt. Daneben sind Faktoren der sozioökonomischen Modernisierung von Bedeutung, während von den institutionellen Variablen lediglich die Wahlkreisgröße einen gewissen Erklärungsgehalt aufweist. Zusammenfassung: Ausgehend von der Beobachtung, dass die zahl durchgeführter Organstreitverfahren vor den Verfassungsgerichten der deutschen Bundesländer eine erhebliche Varianz aufweist, sucht der vorliegende Beitrag nach einer erklärung für das unterschiedlich ausgeprägte Klageverhalten parlamentarischer Minderheiten in den einzelnen Ländern. es zeigt sich, dass Ansätze, die auf das Verhalten der Opposition als Ganzes abzielen, zu kurz greifen. Vielmehr bedarf es eines differenzierten Blicks auf ziele und strategien der verschiedenen Oppositionsparteien sowie auf ihr institutionelles umfeld. Die Analyse zeigt, dass zwischen den zielen der verschiedenen Oppositionsgruppen und der Nutzungshäufigkeit von Organstreitverfahren ein enger zusammenhang besteht.Abstract: the number of "Organstreitverfahren", i.e. German court proceedings concerning disputes among political actors regarding their respective powers, varies greatly between the constitutional courts of the German Länder. this article asks why "Organstreitverfahren" are used to different extents by the parliamentary oppositions in the Länder. Apparently, explanations based on oppositional behavior as such do not provide satisfactory answers. Instead, a more differentiated approach is needed which takes the goals and strategies of the various oppositional parties as well as their institutional surroundings into account. the analysis shows a correlation between the programmatic intentions of the parties and the numbers of "Organstreitverfahren".
