Ce texte présente les nouvelles législations canadienne et québécoise en matière de mariage civil et de filiation. Elle s'attache surtout à la loi québécoise qui a instauré un nouveau système de filiation : la bi-maternité d'origine. Mais non la bi-paternité d'origine puisqu'elle interdit "toute convention par laquelle une femme s'engage à procréer ou à porter un enfant pour le compte d'autrui". Elle crée donc une inégalité entre homosexuels de l'un et l'autre sexe. En instaurant de nouvelles règles de filiation, la loi québécoise s'est abstenue d'aborder la question de la pluriparentalité qui s'impose dans 9 familles homoparentales sur 10 et dans des familles hétéroparentales de plus en plus nombreuses. Une révision fondamentale du droit de la famille dans une perspective universelle reste donc à entamer. »This text describes new Canadian and Quebec legislation as regards civil marriage and filiation. It focuses primarily on Quebec law, which has introduced a new system, that of original bimaternal filiation. However, it does not make room for original bi-paternal filiation since the Civil Code (Art. 541) specifies that: "Any agreement whereby a woman undertakes to procreate or carry a child for another person is absolutely null." In other words Quebec law creates a state of inequality as concerns male and female homosexuals. When it implemented the new rules of filiation, it avoided the question of multiparentality, which now affects nine out of ten homoparental families and more and more heterosexual families. A fundamental revision of family law with a comprehensive perspective now needs to be undertaken
À partir d’une enquête exploratoire auprès de douze primipares francophones de la région d’Ottawa, au Canada, rencontrées trois fois (à leur huitième mois de grossesse, à deux et à six mois après l’accouchement), les auteures décrivent la situation générale des répondantes. Puis elles se penchent sur le récit de ces femmes à propos de leurs attentes et de leur réalité à l’égard de la maternité et elles analysent en particulier le discours des répondantes sur l’allaitement (lors de la deuxième rencontre, sans que cela ait été particulièrement prévu, l’allaitement occupait en effet la place centrale qui reflétait, la plupart du temps, un profond malaise). Puis les auteures présentent les politiques de santé sur l’allaitement maternel, pour ensuite illustrer le différentiel constaté entre la perspective actuellement promue en la matière et l’expérience des femmes rencontrées. Les auteures veulent illustrer comment l’expérience de l’allaitement tend à être encadrée par les professionnelles de la santé de manière telle que le bien-être des parturientes et des nouvelles mères devient un aspect secondaire dans leur expérience. En conclusion, les auteures tentent d’étayer la perspective selon laquelle l’expérience de la maternité subit d’autant plus idéologiquement l’influence du milieu hospitalier que les services offerts aux femmes qui accouchent sont congrus.From an exploratory investigation done with twelve French-speaking first-time mothers living around Ottawa, Canada, we will describe the three visits we did with them : the first visit was during the 8th month of their pregnancy, the second and third visits were at 2 and 6 months after the baby’s delivery. We will then look at their narratives of the expectations, and the reality of giving birth and becoming mothers. We will also report on their breastfeeding experiences. At our second visit, the breastfeeding experience became the main topic, which was described as a profound « malaise » (awkwardness). The second part of this publication will briefly introduce the breastfeeding health policy and describe the current environment of breastfeeding support received, which clearly values the baby’s wellness, often to the detriment of that of the woman giving birth. Lastly, we will put the emphasis on the difference between the promoted official view on breastfeeding and the actual experiences of the women we met. We will conclude by asserting that the experience of motherhood is influenced equally by the ideological perspective offered by the hospital environment, and by the lack of assistance offered to new mothers

Le gouvernement Jospin à Paris est au moins aussi féminisé que le gouvernement Bouchard à Québec. Et le score des députées françaises n'est pas attribuable aux recettes que le Parti Libéral du Canada a de façon paternaliste données à ses candidates pendant la même période, mais, on pourrait en faire l'hypothèse -c'est celle que je choisis -, à une volonté politique aiguillonnée par la revendication de la démocratie paritaire.Cet article est consacré aux interrogations théoriques que suscite cette revendication. Il a été rédigé avec l'objectif d'alimenter un débat qui n'a guère traversé l'Atlantique. Il n'est pas exclu que l'existence des chartes des droits et libertés et le recours de plus en plus fréquent à leurs énoncés, par la voie des tribunaux, donnent le sentiment de ne pas devoir faire appel à une telle revendication non exempte d'ambiguïtés. Je ne le partage pas. La revendication de la démocratie paritaire a le mérite de poser de front la question du rapport de la démocratie moderne à l'universalité. Ce rapport ne peut que buter sur la question de la différence des sexes. L'utilisation de cette dernière formule ne devrait pas ipso facto classer mon propos dans le registre du féminisme 1.
