In this article, I contribute to the comparative literature on trade unions and social pacts, through an analysis of Spanish experience between 1996 and 2016. First, I specify the phases of agreement (‘competitive corporatism’) and confrontation. Second, I examine the impact of the agreements and the subsequent breakdown of tripartite social dialogue on the two most representative trade unions. This makes it possible to explain why these unions accumulated so little strength during the period of consensus, and their evident weakness and the risks they have faced since the start of the crisis and the turn to confrontation.
The literature has shown that, much the same as other employers in southern Europe, the Spanish employers’ peak association, the Spanish Confederation of Employers’ Organisations (CEOE), did not take advantage of the radical legislative deregulation of 2010–2012 and, to the contrary, helped perpetuate the traditional institutions that order the industrial relations system. This article contributes to a better understanding of the underlying reasons that guided the CEOE’s behaviour, and also incorporates the Spanish case into the literature on the adaptation of employers’ organisations – and how the institutions and path dependence have an influence – in the face of the widespread trends of economic deregulation. Finally, this article provides up-to-date, solid and reliable data on membership of employers’ associations in Spain, the lack of which is one of the shortcomings of the literature.
El artículo analiza la influencia de la Confederación Española de Organizaciones Empresariales (CEOE) en el diseño del sistema de relaciones laborales durante la transición y el inicio de la democracia. Pese a la posición de debilidad de partida, con un sistema muy rígido de contratación, costes laborales en ascenso, fuerte conflictividad y falta de partido político de referencia, la CEOE consiguió influir en las políticas laborales y generar un diseño institucional favorable a sus intereses como organización y los de sus representados. En la consecución de tales objetivos se vio notablemente favorecida por la competencia sindical y el impulso de liberalización económica del primer Gobierno socialista. El resultado fue un sistema más flexible, aunque fuertemente fragmentado y no bien articulado; compatible con la gobernanza corporatista, de costes laborales y sociales moderados, y conflictividad baja y declinante.
En este artículo analizo el impacto de las profundas reformas institucionales acometidas durante la Gran Recesión en el rol protector del Estado en el sur de Europa. El modelo de relaciones laborales del sur de Europa sufrió una verdadera crisis normativa debido a la condicionalidad económica de la Troika entre 2010 y 2014. Pero no puede afirmarse que el Estado haya quedado desprovisto de recursos protectores, ni que el impacto haya sido homogéneo ni irreversible. Causas internas y externas explican una pluralidad considerable de resultados. Las instituciones italianas apenas se han alterado e incluso ampliaron la aseguración de los desempleados. En España, la limitación ha sido moderada. En Portugal fue más intensa, pero desde 2015 se ha revisado esa afectación y el salario mínimo nacional ha frenado la desprotección. En Grecia, en cambio, sí se ha producido una desprotección radical y difícil de revertir.
Resumen Pese a su extensa trayectoria y presencia mundial, no son frecuentes los estudios sobre los consejos económicos y sociales (CES). Así pues, se pretende revisar la literatura científica existente sobre estas instituciones, a efectos de identificar los principales núcleos temáticos, acuerdos y discrepancias, como así también detectar las lagunas investigativas y esbozar líneas de investigación futuras. Basándose en la aplicación del Protocolo PRISMA, se han detectado tres núcleos temáticos emergentes sobre los CES: los factores que explican su creación; los factores que inciden en su eficacia (y condicionan su éxito), y los criterios que son utilizados para evaluar su eficacia (relacionados con el éxito o el fracaso de estas instituciones). En suma, se ofrece la primera síntesis cualitativa de la literatura internacional sobre la temática de los CES, centrada en su eficacia y evaluación, de gran utilidad para la intervención y el estudio futuros sobre estas instituciones, especialmente las de nueva creación.
