RESUMO: O presente texto tem como cenário o "apartheid social contemporâneo" que caracteriza a sociedade de controle globalizado onde, apesar da precarização do mercado de trabalho, difunde-se cada vez mais a subjetividade do trabalho formal como a verdadeira natureza do homem. Nesta perspectiva, o "cidadão humano" é aquele que se vincula, rápida e prontamente, à lógica capitalista. Neste contexto, coloca-se em análise o que significam as políticas públicas formuladas e implementadas por este Estado capitalista. Para tal, apresenta-se um pequeno histórico do mito do Estado Democrático de Direito no Brasil, em especial, a partir dos chamados novos movimentos sociais que emergem na segunda metade dos anos de 1970 e por toda a década seguinte. Utilizando-se da perspectiva foucaultiana que se contrapõe aos postulados tradicionais da esquerda, pensa-se o poder como relação de forças imanentes materializadas em práticas, técnicas e disciplinas, diversas e dispersas, presentes em todo o campo social, envolvendo igualmente dominadores e dominados. A partir daí, parte-se para a afirmação de práticas publicizantes que necessariamente não precisam estar vinculadas ao Estado; de direitos construídos na experiência concreta dos homens, de suas lutas, e não do Homem idealizado, de direitos idealizados. Parte-se, enfim, para repensar a relação entre Estado e políticas públicas. PALAVRAS-CHAVE: subjetividades capitalísticas; Estado capitalista; políticas públicas. DEMOCRATIC RULE OF LAW AND PUBLIC POLICIES: DOES STATE-OWNED NECESSARILY MEAN PUBLIC?ABSTRACT: The present work is set in a scenario of "contemporary social apartheid" which represents the society of global control where, despite the growth of precarious work conditions, the subjectivities of formal work are more and more preached as being the true nature of man. From this perspective, the "human citizen" is one that fast and readily relates him or herself to the capitalistic logic. In this context, the meaning of public policies made and implemented by that State is considered. For that purpose, a brief history of the myth of the Democratic Rule of Law in Brazil is presented with an emphasis starting on those considered the new social movements that emerge in the second half of 1970's and throughout the whole following decade. Employing the perspective of Foucault, opposing to the traditional postulates of the Left, power is thought of as the relation of immanent forces materialized as diverse and scattered practices and techniques acting on the whole social field, over dominant and dominated equally. From this point, one moves towards the affirmation of publicizing practices not necessarily linked to the State; of rights constituted in the concrete experience of men, their struggle, rather than of Ideal Man, of idealized rights. At last, one moves towards rethinking the relation between the State and its public policies.
ResumoO processo de Reforma Psiquiátrica em Aracaju-Sergipe, embora recente, é referência nacional. O município dispõe de uma rede de atenção em saúde mental bem estruturada (um CAPS I, um CAPS i/AD, um CAPS AD III, três CAPS III, quatro residências terapêuticas, assistência ambulatorial, retaguarda de uma urgência mental e do SAMU, articulação do cuidado com Atenção Básica) e alicerçada nos princípios do SUS e da Luta Antimanicomial. Mas quando esse processo começa a se desprender dos fluxos que justificaram sua institucionalidade, sem expressivas participações de movimentos sociais, sobressaindo-se desejos de conservação entre gestores, trabalhadores, usuários, comunidade, entre todos nós, poder-se-ia considerar indicativos de uma institucionalização da Reforma Psiquiátrica? Este artigo discute modos de resistir à institucionalização, destacando a estratégia clínico-política do Acompanhamento Terapêutico, transmutando limites em desafios. Sair, pensar saídas, pensar uma clínica da experimentação, uma forma de conhecer encarnada, um trabalho terapêutico exposto à vida, eis o nosso objetivo.Palavras-chave: saúde mental; reforma psiquiátrica; institucionalização/ resistência; clínica; acompanhamento terapêutico. AbstractThe process of Psychiatric Reform in Aracaju-Sergipe, although recent, is a national reference. The city has a network of mental health attendance well equipped (one CAPS I, one CAPS I/AD, one CAPS AD III, three CAPS III, four therapeutic residences, outpatient assistance, support of a mental urgency and of SAMU, articulation of care with Primary Health) and based on principles of SUS and of the Antimanicomial Movement. However, when this process begins to self release from the fluxes which justified its institutionalism, without expressive involvement of social movements, over projecting desires of conservation among managers, workers, users, community, among all of us, could it be possible to considerate indicatives of Psychiatric Reform institutionalization? This article discusses ways of resisting the institutionalization, highlighting the strategy clinical -political of the Therapeutic Accompaniment, transmuting limits in challenges. Exiting, think about exits, a clinic of experimentation, a therapeutic work exposed to life, here is our aim.
RESUMOO artigo trata as questões do "Estado" e da "Política" partindo do exemplo concreto do processo de institucionalização, no Brasil, de práticas profissionais em psicologia reconhecidas como Análise Institucional (vertente grupalista francesa consideravelmente difundida nos últimos 20 anos). Trabalho para expor uma face menos visível da judicialização que funciona ao nível das concepções, crenças e valores entre os operadores dos equipamentos onde se materializam as políticas públicas engendradas pelo excesso legalista. Dentre as modalidades desse apego à lei, toma-se em análise aquela mais próxima de nossas práticas de funcionalismo público marcando o índice de grau máximo de sua institucionalização: a aceitação consensual da competência como critério de legitimidade na operação dos "instrumentos da violência institucional". Palavras-chave: função pública; militância; análise institucional; método como estratégia. ABSTRACTThis article regards the issues of 'State' and 'Politics' starting from the concrete example of the institutionalization process, in Brazil, of professional practices in psychology recognized as Institutional Analysis (french branch of group psychology considerably spread in the last 20 years). I try to expose a less visible face of the judicialization that works at the level of beliefs and values among the operators of the equipments where the public policies are materialized engendered by the legalist excess. Among the modalities of this attachment to law, it is taken into analysis that one closer to our public practices labeling the utmost grade index of its institutionalization: the consensual acceptance of the capacity as a legitimacy criterion in the 'instruments of institutional violence' operation.
