Resumo O objetivo deste artigo é descrever o recente litígio estratégico que culminou com a transformação jurídica ocorrida no Brasil em relação à obrigatoriedade de financiamento de campanhas políticas de mulheres. Dessa perspectiva, buscar-se-á analisar criticamente as questões em jogo no julgamento da ADI 5617 pelo Supremo Tribunal Federal realizado em março de 2018, que determinou o mínimo de 30% de investimento dos partidos em campanhas de candidatas. O caso será abordado do ponto de vista da atuação da Clínica jurídica “Laboratório de Direitos Fundamentais” da FGV Direito Rio, na qualidade de representante da ONG CEPIA como amicus curiae nessa ação. A partir dessa experiência, pretende-se refletir sobre os desafios do uso de litígio estratégico para o avanço de direitos humanos em geral, e de direitos políticos de mulheres no Brasil em especial.
O objetivo do trabalho é descrever e analisar a desigualdade de gênero nas eleições proporcionais de 2018 a partir dos seguintes parâmetros: i) o número de candidaturas masculinas e femininas; ii) o perfil sociodemográfico de candidatas e candidatos; iii) competitividade de mulheres e homens e, ainda, a relação entre votos; iv) e o volume de recursos financeiros de campanha declarados por candidatas e candidatos. A metodologia se deu com base em estatísticas descritivas dos dados brutos do Tribunal Superior Eleitoral (TSE), avaliando parâmetros de candidaturas, competitividade e gastos. A análise desses parâmetros revela que os partidos cumpriram, à risca, o patamar mínimo de candidaturas femininas definido em lei, de 30% de nomes nas listas partidárias. Além disso, observou-se um possível efeito do estado civil em interação com gênero desfavorável à representação feminina. Esse dado parece refletir, na arena eleitoral, constatações mais gerais a respeito da variação da desigualdade de gênero no Brasil associada à divisão sexual do trabalho reprodutivo. Para descrever a competitividade de candidatas e candidatos, foi elaborada uma tipologia a partir da regra que define o patamar mínimo de 10% quociente eleitoral como requisito para obtenção de representação. Observou-se um expressivo contingente de mulheres subcompetitivas. Isso ajuda a explicar outro achado do artigo: o fato de que as vagas adicionais nos legislativos estaduais obtidos pela expressividade da votação de algumas poucas mulheres “puxadoras de votos” foram preenchidas, em geral, por homens. Por fim, o artigo revela que, considerando um mesmo volume de recursos de campanha, os homens, em sua grande maioria, recebem mais votos que as mulheres. A descrição da desigualdade de gênero, a partir das eleições proporcionais de 2018, dialoga diretamente com os principais temas da literatura sobre desigualdade de gênero na política. Espera-se que a análise empreendida no artigo contribua para o diálogo e ações que visem promover uma maior igualdade entre homens e mulheres na política brasileira.
In this article the authors aim to understand the specificity of violence against Black women in Brazilian politics through the analysis of testimonies of Black politicians in different administrative positions and various regions of Brazil. Adopting the “Violence Against Women in Politics” (VAWIP) analytical model developed by Mona Lena Krook, the goal of this approach is to highlight the forms that this violence takes in the Brazilian context when gender and race intersect. In doing so, the article pursues two objectives. First, it offers an overview of violence against Black women in Brazilian politics, demonstrating how this phenomenon manifests itself in the analysis of these cases. Second, it observes how the testimonies of Black women politicians go beyond the analytical model proposed by Mona Lena Krook (2020), thus accounting for the intersectional specificities of political violence.
Por que razão o Estado, por meio do direito, se arroga na posição de determinar quem é ou pode ser homem ou mulher (e somente uma das duas opções), em quais circunstâncias, sob que requisitos? O objetivo do presente artigo é investigar a regulação dos direitos de pessoas trans* no Brasil e na Alemanha. Os dois países são aqui vistos como duas faces de uma mesma moeda: meu argumento é de que o conceito de 'dano', à luz da perspectiva crítica dos estudos de gênero, especialmente do conceito de heteronormatividade, pode ser a chave para entender as contradições, retrocessos e avanços, assim como para questionar, criticar e oferecer alternativas quanto a direitos e leis sobre transexuais. A identificação dessas tensões me levará a concluir que a redefinição do sentido de 'dano' foi essencial para compreender as variações ocorridas nos respectivos direitos. Por fim, será proposta uma perspectiva mais inclusiva para o reconhecimento jurídico da diversidade das identidades trans.
