Em 1968 a comunidade médica internacional cunhou o conceito “morte encefálica” que passou a ser utilizado para diagnosticar pacientes que, até então, se encontravam na condição do que se conhecia como “coma irreversível”. A partir desse momento, quando o cérebro não apresentasse mais nenhuma atividade biológica, porém, o coração permanecesse em funcionamento, estar-se-ia diante de um caso de morte encefálica. Para a medicina, isso implicou a possibilidade da realização de remoção de órgãos para cirurgias de transplantes, mas, além disso, também representou uma nova maneira de conceber a morte. O presente artigo analisa, a partir da realização de entrevistas com roteiro semiestruturado entre médicos envolvidos neste contexto, o processo de diagnóstico de morte encefálica e a negociação que se estabelece entre os diferentes atores sociais envolvidos neste processo de definição de morte.
Resumo: Este trabalho analisa a intersecção entre religião e saúde procurando compreender como que a biomedicina interfere nos significados e premissas religiosas e os impactos produzidos na esfera religiosa a partir do processo de adoecimento biomédico. Nossa análise foi desenvolvida a partir do estudo etnográfico em uma casa de religião de matriz africana na cidade de Porto Alegre (Brasil) que pratica sessões de cura espiritual. Our analysis was developed from the ethnographic study from an "African religious house" in the Porto Alegre city (Brazil) that was practicing spiritual healing sessions.
O presente artigo tem como objetivo refletir sobre o caráter contratualista e legalista dos Comitês de Ética e Pesquisa, a partir da análise de três elementos com os quais me deparei ao longo de minha trajetória enquanto pesquisadora: 1) a falta de homogeneidade nas avaliações éticas; 2) a falta de acesso e a objeção de consciência presentes em alguns Comitês e; 3) a centralidade do Termo de Consentimento Livre e Esclarecido para determinar o caráter ético de uma pesquisa. Defendo a ideia de que o sistema CEP/Conep está ancorado em uma perspectiva moral regida pela legalidade e pelo contratualismo, que resume a ética em pesquisa a um conjunto de procedimentos morais que não soluciona as desigualdades de poder entre pesquisadores e pesquisados.
ResumoO artigo tem como objetivo compreender as concepções de risco acionadas pelo campo médico e interpretadas pelo campo jurídico a partir da análise de decisões judiciais relativas à autorização do aborto de fetos com anomalias fetais incompatíveis com a vida e de entrevistas não-diretivas realizadas entre médicos e magistrados. Verificamos que a categoria de risco é bastante manipulada por médicos e magistrados na medida em que essa categoria é acionada enquanto uma justificativa para tornar moral o aborto de fetos inviáveis, com o objetivo de afastar o aborto da esfera da escolha individual da gestante para inseri-lo no âmbito do aborto terapêutico.Destaca-se também o caráter polissêmico do discurso sobre risco, tendo em vista que ele é utilizado tanto para conceder ou negar as autorizações judiciais para aborto, como para atribuir a responsabilidade da decisão sobre o aborto aos médicos. AbstractThe article seeks to understand the conceptions of 'risk' produced in the medical field as they come to be interpreted in the legal field. It draws on legal decisions concerning authorization for aborting fetuses bearing anomalies incompatible with life, and on non-directive interviews with medical doctors and magistrates. The category of 'risk' was found to be subject to considerable manipulation by both doctors and magistrates in being deployed as moral justification for the abortion of non-viable fetuses.Abortion is thus displaced from the sphere of individual choice to the domain of therapeutic abortion.
