<p>La maternidad subrogada es una cuestión que ha aparecido en los últimos tiempos, cada vez con más incidencia, en la actualidad. Los poderes económicos, políticos y los medios de comunicación han acercado a la ciudadanía un concepto, estrictamente técnico, con el fin de familiarizar esta técnica. Esta estrategia se ha amparado en la natural tendencia a considerar que cualquier avance tecnológico es bueno de por sí, de manera que no se han revisado y puesto al alcance de los ciudadanos, de forma razonable, ninguna de las cuestiones que deben de tratarse con esta técnica. Así, cabe hacer un estudio de la normativa y jurisprudencia de los supuestos que han ido produciéndose y considerar la realidad que implica esta formulación no solo para los demandantes de esta forma de reproducción, sino también desde el prisma de la mujer que va a gestar el niño, así como de la posición en la que quedará el niño tras este proceso. La dignidad tanto de la madre biológica como la del niño desaconsejan llevar a cabo este tipo de prácticas ya que únicamente trata de satisfacerse un supuesto derecho a ser padre o madre, derecho que no tiene consistencia jurídica, ya que para ello se pervierten otros derechos de los sujetos implicados y, especialmente, se pasa por encima de la dignidad tanto de la madre gestante como del niño que resulta del proceso.</p>
Las tecnologías de la información y la comunicación son un elemento extraordinario para innovar en el ámbito educativo, tal y como ha mostrado la situación generada por el COVID-19. Así, en el ámbito del Derecho son múltiples las posibilidades que se derivan de la implementación de estas herramientas para mejorar el nivel de la enseñanza y facilitar la incorporación de los estudiantes al mundo laboral. Ahora bien, la tecnología no es un fin en sí mismo, por lo que habrá que valorar la introducción de estas herramientas como complemento y no como un sustitutivo de la tarea educativa, especialmente en el ámbito del Derecho, que exige la formación de juristas con una visión integral de la realidad jurídica. Para ello es muy útil el uso de plataformas digitales e, incluso, el crecimiento de la docencia online, siempre que se emplee para generar juristas comprometidos con el Derecho y la Justicia y no meros expertos tecnológicos del mundo del Derecho
La participacion ciudadana se presenta hoy, dentro del discurso politico, como la panacea legitimadora y revitalizadora por excelencia de la desgastada y denostada democracia representativa. Sin embargo, los instrumentos que supuestamente la promueven, el lenguaje con el que se la propone y la enorme fuerza con la que ha irrumpido en el panorama politico la ‘posverdad’, capaz de imponer en la opinion publica una version adulterada y falseada de la realidad, han provocado no solo que el ciudadano se retraiga y desconfie todavia mas de la fuerza regeneradora del actual paradigma participativo, sino que debamos ponernos en guardia ante el extraordinario poder manipulador que se encierra en la conjuncion de participacion y posverdad, frente a las exigencias basicas de transparencia y veracidad propias de una autentica democracia.
Pese a que la ciudadanía, en algunos países de nuestro entorno, ya gozaba en el siglo XX de tímidas medidas para conocer información en poder de las Administraciones y gobiernos, no fue hasta comienzos del siglo XXI cuando en el continente europeo comenzó a surgir el debate de si este derecho de acceso a la información pública debía ser considerado como derecho fundamental y, por tanto, merecedor de la protección que ello conlleva. En una sociedad, como la nuestra, donde prima el conocimiento, se ha llevado a cabo una transformación normativa que ha permitido acercar la información pública a la ciudadanía, ya sea de forma directa proporcionada por la Administración, o bien, ejerciendo el derecho de acceso reconocido en la Ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno.
