L'éléva-tion du principe de précaution au rang de principe constitutionnel a fait l'objet d'une controverse sévère entre industriels ou scientifiques craignant la paralysie de la décision et de l'innovation, et défenseurs d'une vision progressiste du déve-loppement durable. Une part de cette controverse tient dans la crainte de dérives dans son application liées à un autre principe -le principe de participation des citoyens aux processus décisionnels -qui reconnaît le droit de tout citoyen de « participer à l'élaboration des décisions », par exemple en invoquant le principe de précaution. Le principe de participation, qui a pu sembler faire consensus lors des discussions sur la Charte de l'environnement, est au coeur des conflits d'amé-nagement et d'environnement depuis une quinzaine d'années. Dans ces conflits, notamment sur les grands projets d'infrastructure, de nouvelles pratiques de démocratie participative sont nées au cours des années 1990. Leur institutionnalisation progressive, et aujourd'hui leur reconnaissance constitutionnelle, font l'objet de controverses plus pratiques que théoriques, qui n'en touchent pas moins au sens politique et à la portée du principe.Les conflits que ne cesse de provoquer la mise en oeuvre du débat public dans le domaine de l'aménagement interdisent ainsi d'assigner trop vite son institutionnalisation progressive à la montée d'une nouvelle « norme délibérative » qui caractéri-serait les transformations de l'action publique (Blondiaux et Sintomer [2002]). La persistance des actes opposant démocratie participative et démocratie représentative souligne au contraire que la construction sociale de l'articulation entre participation du public, délibération, élaboration des projets et décision reste un objet controversé de politisation de l'action publique. Mais, comme nous l'indique Pierre Rosanvallon, « c'est toujours dans les conditions de sa mise à l'épreuve que peut se déchiffrer le politique » (Rosanvallon [2003], p. 30, souligné dans le texte). Plutôt que regarder ce processus comme l'institutionnalisation d'une nouvelle norme délibérative reconfigurant l'action publique, nous prenons ici le parti d'étudier l'expérience démocratique que font les participants à ces nouvelles procédures, en nous centrant sur les débats organisés par la Commission nationale du débat public (CNDP) 1 , pour comprendre comment les pratiques délibératives reconfigurent la citoyenneté.1 La CNDP a été créée par la loi « Barnier » du 2 février 1995. La loi de démocratie de proximité du 27 février 2002 lui a donné le statut d'autorité administrative indépendante et a élargi ses préroga-tives. Debate (NCPD) is becoming the French reference in matters of participatory democracy. This article highlights the rules of procedure which distinguish the forums opened by the NCPD from the consultative committees set up in other areas of environmental policy-making. The public discussion of the projects expresses first and foremost a change in the nature of the conflicts, which concern today as much the legitimacy of the projects as the manner in which they are implemented. The experience of the first debates organised by the NCPD underlines the great potential of a really open forum to encourage the participation of the public. The four deliberative rules embodied in the independent Commission responsible for organising the debate constitute the originality of the procedure, by which a contradictory, pluralistic and egalitarian dialogue can take place between the participants. This gives a sense of democracy to the decision-making process as a whole.
