A Avaliação de Impacto Ambiental surgiu como resposta jurídica para o desenvolvimento econômico dos Estados alinhado a uma proteção ambiental de seus recursos naturais, sendo hoje tida como um dos principais instrumentos do Direito Ambiental, tanto na esfera interna quanto internacional. Ocorre que com a alteração da classificação do desenvolvimento econômico brasileiro de país subdesenvolvido para Estado em desenvolvimento, a avaliação de impacto ambiental passou a ser cada vez mais necessária, porém nem sempre observada em seus resultados quanto à concessão da licença ambiental, o que pode ocasionar prejuízos para as gerações futuras.
O presente artigo tem por escopo abordar as políticas públicas de defesa e proteção às crianças refugiadas no Brasil como forma de inclusão à sociedade brasileira, bem como a possível necessidade de criação de novas políticas e/ou seu aperfeiçoamento, tendo em vista os reflexos sociais e mesmo econômicos decorrentes das ações, bem como das omissões do Poder Público, uma vez que o número de refugiados ou solicitantes provenientes de distintas partes do globo que vem se deslocando em direção ao território brasileiro, seja em função de perseguições por razões variadas, seja em razão de conflitos armados tem crescido de modo significativo nos últimos anos. Dentre o grande contingente de migrantes em situação de refugio ou que podem solicitar o status de refugiado, ou mesmo o reassentamento, está um número também cada vez maior de crianças, sejam acompanhadas ou não de um responsável maior de idade. Vale frisar que as crianças refugiadas se encontram numa situação de dupla vulnerabilidade, tanto pela condição de refugiado como pela menoridade, o que pode colocá- los numa situação de risco no solo estrangeiro para os quais migram, razão pela qual o amparo e a fruição de direitos inerentes à pessoa humana, sobretudo os direitos sociais, são de suma importância para que sejam protegidas e incluídas à sociedade brasileira, para que possam exercer uma cidadania lato sensu. Para melhor abordagem da temática, utilizou-se de pesquisa bibliografia e exploratória, calcada na legislação nacional e internacional, bem como doutrina e sites oficiais e não oficiais.
Fundamental Human Rights comprise, within the Brazilian Federal Constitution of 1988, commonly known as the Citizen Constitution, one of the main rights to be observed and enforced by the Brazilian State, being inserted right at the beginning of the Constitutional text, unlike the other constitutions of the Country. In this sense, such paper tries to demonstrate that these rights were not merely inserted into it, but they are a result of historical social achievements and also an evolutionary process of a systematic understanding regarding what human rights are. The study also analyzes the effectiveness of human rights not only in the field of law but also in the factual field, with the real applicability of such rights in Brazilian society, as this is one of the greatest difficulties today. For that, we used a qualitative research methodology, based on exploratory and descriptive method, based on national and international doctrines as well as sites.
