Narcotics abuse has become a necessity in the modern world. Law No. 35 of 2009 on Narcotics is strictly regulated on what actions can be categorized as criminal offenses and what sanctions will be faced by those legally and convincingly proven to be the perpetrators of narcotics abuse. In the past 5 years, the government has massively enforced law enforcement and law enforcement in the field of narcotics and has sent dozens of people to challenge death against firing squads in the execution process. Fidelis a civil servant from Sanggau West Kalimantan, was arrested by the BNN apparatus for being proven to plant marijuana at his home. Through a process integrated in the Indonesian criminal justice system, the judge finally ruled that Fidelis was legally and convincingly guilty and sentenced to 8 months in jail plus a fine of 1 billion 1-month subsidence cage. Many parties admit it because Fidelis should be tried and punished, but many also praise the courage of the judge who has decided the case by using the attachment of progressive legal theory.
AbstrakUpaya keras dalam penegakan undang-undang cukai, sanksi pidana digunakan sebagai alat untuk memberikan daya paksa yang maksimal bagi masyarakat wajib cukai. Namun sejatinya ketentuan pidana adalah upaya terakhir manakala sanksisanksi andministrasi tidak lagi bekerja secara optimal. Penelitian ini menggunakan Metode Penelitian hukum normatif. Suatu pelanggaran untuk dapat dikategorikan sebagai tindak pidana tidak lepas dari legalitas dari subyek hukum yaitu pengusaha BKC maupun obyek hukum yaitu BKC dan Pita Cukai. Bilamana salah satu dari subyek hukum atau obyek hukum bersifat ilegal, maka pelanggaran yang dilakukannya tersebut adalah suatu bentuk tindak pidana. Disamping itu, suatu perbuatan dapat dipidana berdasarkan undang-undang Cukai apabila memenuhi kriteria sebagai berikut: dirumuskan secara tegas dan jelas sebagai pelanggaran, secara nyata menimbulkan kerugian negara, dan merupakan perbuatan yang berulang, atau kerugian negara yang ditimbulkan tidak dapat diperbaiki. Penerapan asas ultimum remidium dalam penegakan hukum di bidang cukai perlu menggunakan teori restorative justice untuk merestorasi kerugian negara yang ditimbulkan oleh para pelaku tindak pidana di bidang cukai, dan teori social cost untuk memberikan tambahan biaya dan resiko yang ditanggung oleh para pelaku kejahatan agar mereka mengurungkan niat melakukan kejahatan. Abstract Strict efforts in enforcing excise laws, criminal sanctions are used as a tool to provide maximum forced power for the excise duty community. But the truth is that criminal provisions are the last resort when administrative sanctions no longer work optimally. This study uses normative legal research methods. An offense to be categorized as a criminal offense cannot be separated from the legality of the legal A R T I C L E I N F O| 12 | subject, namely the BKC businessman and the legal object, namely the BKC and the Excise Band. If one of the legal subjects or legal object is illegal, then the violation committed is a form of criminal offense. In addition, an act can be convicted under the Customs law if it meets the following criteria: explicitly and clearly formulated as a violation, significantly causing state losses, and is a recurring act, or state losses incurred cannot be repaired. The application of the principle of ultimum remidium in law enforcement in the excise sector needs to use the theory of restorative justice to restore state losses caused by criminal offenders in the excise field, and social cost theory to provide additional costs and risks for criminals to dissuade them commit crime.
This study discusses criminal liability towards companies that fail to register their workers as participating BPJS workers. Social security is very important for all Indonesian workers to have because socioeconomic risks can occur to anyone, anywhere and to anyone. This study aims to analyze the urgency of the Criminal Regulation concerning Ngelem according to Law Number 35 of 2009 concerning Narcotics. The problem approach used is normative juridical supported by empirical juridical. The data used are primary. Data analysis was performed descriptively qualitatively. The results of the study showed that the application of the law against nuisance users according to Law Number 35 of 2009 concerning Narcotics and Regulation of the Minister of Health of the Republic of Indonesia Number 44 of 2019 concerning changes in the classification of Narcotics in Indonesia cannot be processed by law enforcement officials. This is because it has not yet been regulated about addictive substances in Ngelem content. So it is necessary to make changes to the Law Number 35 the Year 2009 and the Regulation of the Minister of Health of the Republic of Indonesia Number 44 the Year 2019 regarding the change in the classification of Narcotics Abstraks Penelitian ini bertujuan untuk menganalisis urgensi Pengaturan Pidana tentang Ngelem menurut Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika. Pendekatan masalah yang digunakan yuridis normatif didukung dengan yuridis empiris. Data yang digunakan adalah data primer. Analisis data dilakukan secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa penerapan hukum terhadap pengguna ngelem menurut Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika dan Peraturan Menteri Kesehatan Republik Indonesia Nomor 44 Tahun 2019 tentang perubahan penggolongan Narkotika yang ada di Indonesia tidak bisa diproses oleh aparat penegak hukum. Hal ini karena belum diatur tentang zat adiktif pada kandungan Ngelem. Sehingga perlu dilakukan perubahan perubahan terhadap Undang-Undang Nomor 35 Tahun 2009 dan Peraturan Menteri Kesehatan Republik Indonesia Nomor 44 Tahun 2019 tentang perubahan penggolongan Narkotika.

The need for a change in the organizational structure of the Polres supervision section with the addition of a section specifically handling community complaints in the Polres Supervision Sub Section so that it does not overlap with other work. Abstraks Tujuan penelitian adalah untuk menganalisis penanganan laporan pengaduan masyarakat yang tidak dapat ditangani dengan baik terhadap proses penyidikan Polri dan regulasi peraturan Kapolri tentang penanganan laporan pengaduan masyarakat terhadap proses penyidikan Polri pada tingkat Polres dan Polsek di masa mendatang. Pendekatan masalah yang digunakan adalah yuridis normatif didukung dengan yuridis empiris. Data yang digunakan adalah data primer. Teknik Analisis yang digunakan dalam penelitian hukum normatif. Hasil dari penelitian menunjukkan bahwa petugas seksi pengawasan Polres diharapkan dapat melayani dengan baik setiap pengaduan masyarakat dan tuntas terhadap proses penyidikan Polri pada tingkat Polres dan Polsek. Perlunya adanya perubahan struktur organisasi seksi pengawasan Polres dengan penambahan bagian yang khusus menangani pengaduan masyarakat pada Sub Seksi Pengawasan Polres sehingga tidak terjadi tumpang tindih dengan pekerjaan lainnya.

Faktor-faktor yang menghambat penerapan upaya pengalihan terhadap anak-anak yang menyalahgunakan narkotika di Pengadilan Negeri Banjarbaru adalah:Pemahaman petugas penegak hukum yang terlibat dalam proses Diversion masih kurang. yaitu pihak-pihak yang terlibat dalam proses pengalihan, seperti Pengawas Komunitas / Bapas termasuk penasihat hukum / penasihat hukum yang magang, termasuk hakim remaja, harus lebih akrab dengan isi Perma No. 4 tahun 2014 tentang Pedoman Pelaksanaan Diversi pada Anak Sistem Peradilan Pidana dan Peran Orang Tua dalam proses Pengalihan masih kurang aktif karena kurangnya pemahaman tentang proses tersebut.

This study seeks to answer the background of fraud in online job vacancies as well as a form of countermeasures against fraud in online job vacancies.
