This study aims to explain the proof of the minutes of auction for the winner of execution of mortgage rights, this research method is empirical juridical. Techniques for collecting data through literature and field. Data were analyzed using a qualitative approach. And the auction winner could not destroy the object, the auction winner should have the right to control the auction object. Judges' decisions should pay attention to justice and benefits for the parties because the judge is not a mouthpiece of law, according to Article 10 paragraph (1) of Law number 49 of 2009 concerning judicial power.
This paper describes the process of marriage itsbat in Aceh and its approval factors despite its non-compliance with the applicable provisions. From the study results, it is known that the judge determining marriage itsbat prioritized benefit (maslahah) for the litigants. Its approval is considered to have more positive impacts, both for the litigants and their children. When it is granted, their marriage has had legal force and is recognized by the state, with the result that the litigants and their children have the same rights as those who register their marriage. This study used empirical legal research method obtained by conducting interviews. For further suggestion, it is expected that the government give legal socialization to increase public awareness of the importance of marriage registration
Child custody after divorce is not always placed under the care of the mother. There is also custody handed over to his father in the judge's decision. Like the verdict Number 65 / Pdt.G / 2011 / MS-Bna which gives custody to the father. This is also the case in decision Number 55 / Pdt.G / 2012 / Ms-Bna which gives custody of children to their mothers. This study aims to find out why judges' decisions differ from one another in providing child custody after divorce and analyzing the juridical aspects of child protection after divorce after a divorce. The study uses normative juridical research methods. The legal materials used consist of primary and secondary legal materials. Data analysis was performed qualitatively and described descriptively. The results showed that aspects of child protection after divorce, namely: first, the child has the right to get care from both parents. Second, the costs of caring for and educating children are the responsibility of their fathers. Third, the father acts as guardian if the child is a girl. Fourth, between parents and children still inherit each other among each other.
Abstract:-Business activities in Indonesia consider family principle as an important aspect because this principle is the character of Indonesian life. Family principle comprises two values, i.e. mutual assistance and deliberation, as a depiction of Pancasila, the ideology of Indonesian people. These two pillars have become the main characteristics of Indonesian culture, which has the value of collectivism. Other values are applicable in other legal systems in Indonesia, such as in a memorandum of understanding, as long as they are in line with the two values of family principle.
