A violência doméstica e familiar contra a mulher é um problema afeto a todos os domínios da esfera social. No entanto, raramente o tema é trabalhado à luz dos desdobramentos que transcendem os limites da vida privada da vítima. A violência perpetrada contra a mulher possui raízes em concepções e valores primitivos que replicam a ideia da manutenção da mulher em papéis estereotipados ligados à desigualdade de gênero e em posições hierarquicamente estabelecidas. Assim, com o objetivo de investigar as projeções da violência doméstica na sociedade, o presente estudo, pautado no método de pesquisa dedutivo, busca demonstrar o liame estabelecido entre violência doméstica, desenvolvimento econômico e desenvolvimento humano, identificando-se a parcela de impacto da violência doméstica no desenvolvimento econômico do país, com base nos custos gerados pela violência doméstica ao orçamento do Sistema Único de Saúde e na sua interferência no mercado de trabalho e na vida laborativa da mulher vítima. Ao considerar as implicações do progresso econômico no investimento em áreas essenciais do desenvolvimento humano, e identificar a associação intrínseca entre violência doméstica e desigualdade de gênero, a pesquisa permite concluir que as projeções adjacentes à violência doméstica têm impacto significativo sobre o desenvolvimento econômico e humano do país.
RESUMO O Poder Judiciário tem assumido uma participação significativa na efetivação dos direitos fundamentais. O exercício da função jurisdicional pautado nessa atitude que ultrapassa as funções típicas atribuídas ao Judiciário pode ser denominado como ativismo judicial. É a atuação expansiva do Judiciário frente à omissão do Legislativo ou à inércia do Executivo, determinando, por exemplo, a implementação de políticas públicas que garantam os direitos constitucionalmente assegurados. O fenômeno do ativismo judicial é também objeto de críticas, havendo discussões quanto ao alcance dessa interferência do Poder Judiciário na seara dos demais poderes. Assim, o presente estudo buscou analisar os impactos do ativismo judicial na sociedade brasileira, abordando como ponto máximo a garantia do direito à educação básica que vem sendo defendida e assegurada pelos Tribunais em decorrência do novel modo de se aplicar o direito, que permite além de dizê-lo, de fato, efetivá-lo. O estudo em questão objetiva demonstrar o processo de evolução logrado pela união estável na sociedade brasileira ao longo da história e os avanços deflagrados após o seu reconhecimento constitucional como sendo uma entidade familiar idônea que goza da proteção do Estado. A presente pesquisa também será voltada à recente decisão do Supremo Tribunal Federal (STF) no julgamento dos Recursos Extraordinários 646.721 e 878.694, que decidiu pela equiparação sucessória da união estável em relação ao casamento civil. Na decisão, o STF declarou inconstitucional o artigo 1.790 do Código Civil de 2002, motivado pela vedação ao retrocesso e por julgar tal dispositivo como sendo violador de princípios. RESUMOTrata o estudo de análise da n. Lei 12.654/12 quanto à coleta de dados genéticos para identificação criminal do civilmente identificável. A identificação criminal se dá quando os documentos apresentados pelo acusado são insuficientes para a sua individualização. Neste caso, poderá ser feita através do método datiloscópico, fotográfico e, em casos essenciais, por coleta de perfil genético. Contudo, surgem divergências por serem tais dados utilizados não para a identificação, mas sim como meio de prova na instrução processual, o que resulta na ofensa de direitos fundamentais previstos pela Constituição Federal a todos os cidadãos, como na violação dos princípios da presunção de inocência e do nemo tenetur se detegere. Conclui-se que a identificação criminal genética acaba por evidenciar uma finalidade diversa, ainda que implicitamente, da mera identificação. Palavras-chave: Direitos fundamentais. CONSIDERATIONS ON THE LAW N. 12.654/2012: IDENTIFICATION OF CRIMINAL AS MASKED FASHION PROOF OF OBTAINING ABSTRACTThis study analysis of Law n. 12.654/12 concerning the collection of genetic data for criminal identification civilly identifiable. The criminal identification occurs when the documents submitted by the accused are insufficient for their individualization. In this case, it may be done through the fingerprint method, photographic and in essential cases, by genetic profile collection. However, there are differences to be such data used not to the identify, but as evidence in legal discovery, resulting in fundamental rights offense provided for by the Constitution to all citizens, and in violation of the principles of the presumption of innocence and the nemo tenetur if detegere. It is concluded that genetic criminal identification eventually show a purpose, albeit implicitly, the mere identification.
O objetivo é apresentar, do ponto de vista filosófico, a relação existente entre o cosmopolitismo kantiano e a figura do refugiado à luz do Direito à Hospitalidade. Orienta-se pelo procedimento da pesquisa bibliográfica. Apresenta o ideal filosófico de Kant para a instituição da Paz Perpétua com ênfase no Direito Cosmopolita. Demonstra a correspondência entre Direito Cosmopolita, Direitos Humanos e Direito Natural. Analisa o refugiado sob a perspectiva filosófica. Viabiliza o diálogo entre o cosmopolitismo e o refugiado. Por fim, conclui que há um entrelaçamento teórico e filosófico entre o refugiado e o Direito Cosmopolita baseando-se na concepção da cidadania universal.
