■ Francine Soubiran-Paillet : Juristes et sociologues français d'après-guerre : une rencontre sans lendemain Cet article dresse le bilan des rapports entretenus entre juristes ouverts à la sociologie du droit et sociologues de l'après-guerre. Le contexte institutionnel est favorable à un rapprochement entre les deux disciplines, en la création du Centre d'études sociologiques et de la VIs section de l'École pratique des hautes études. Vingt ans plus tard, la configuration institutionnelle aura changé et la dynamique antérieure, complètement disparu.
L'analyse sociologique de P. Bourdieu sur le droit est indissociable de son entreprise d'explication du monde social. La présente réflexion se greffe sur des travaux d'ordre ethnologique, entrepris dans les années soixante. L'habitus y occupe une place essentielle. Bourdieu accomplira deux démarches en sens inverse, dans le temps, pour mettre en relation habitus et règle de droit. Il cherchera d'abord à en découdre avec le juridisme, en s'efforçant de fonder une théorie adéquate de la pratique. Cela ne l'empêchera pourtant pas de s'interroger, plus tard, à propos des effets de ce juridisme sur les agents sociaux, donnant ainsi un caractère paradoxal à sa sociologie. Le champ juridique et l'attention portée aux professionnels qui mettent en œuvre les règles de droit, plutôt qu'à ceux qui les élaborent, constituent les apports fondamentaux de cette sociologie d'inspiration largement weberienne.
