RESUMO:Este artigo aborda a temática do meio ambiente e desenvolvimento a partir da problematização trazida pela Ética Ambiental, uma filosofia que critica o antropocentrismo. Nesta linha, a perspectiva dos direitos da natureza, previstos pela primeira vez pela Constituição do Equador, enseja controvérsias variadas. Entre elas, se é procedente afirmar que os direitos da natureza representam uma moral biocêntrica. A questão impacta essencialmente o que se entende por desenvolvimento sustentável.Palavras-chave: Meio Ambiente. Ética Ambiental. Desenvolvimento. ABSTRACT:This article approaches the theme of the environment and development from the problematization brought by Environmental Ethics, a philosophy that criticizes anthropocentrism. In this line, the perspective of the rights of nature, foreseen for the first time by the Constitution of Ecuador, provokes varied controversies. Among them, it is appropriate to affirm that the rights of nature represent a biocentric morality. The issue essentially impacts on what is meant by sustainable development.
Este artigo pretende, a partir do dispositivo constitucional que determina a não submissão dos animais a crueldade, abordar criticamente o julgamento da ADI n. 4983/CE e indicar os principais problemas decorrentes da percepção de que o caso envolve um suposto conflito entre os princípios da liberdade de manifestação cultural e de tutela e proteção da fauna, ambos protegidos constitucionalmente. O caso é emblemático por revelar as dificuldades de enfrentamento do problema da exploração e abuso de animais no país, questão diretamente vinculada ao estatuto moral e jurídico dos animais. A metodologia utilizada envolveu a análise de precedentes judiciais acerca da temática analisada, especialmente os provenientes do Supremo Tribunal Federal - STF, bem como revisão da doutrina constitucional e da teoria geral do Direito. Como resultado da pesquisa, pretende-se demonstrar que, no caso em debate, a melhor solução envolve a aplicação de uma regra constitucional e não de ponderação principiológica. A aplicação da regra, no caso concreto, deve operar em favor da compreensão da inconstitucionalidade da lei cearense que regulamenta e permite a atividade da "vaquejada".
Este texto promove, a partir da circunstância brasileira, em especial na ambiência da pandemia, uma análise entre o que podemos denominar de reserva de governo e de reserva da ciência. A relação entre estes dois sistemas, que deveria ser harmoniosa, integrada, operacionalizada pelo Direito, manifesta-se, no Brasil, em um governo sem reservas, que tem o ímpeto de politizar a ciência, que reserva a ela a subjugação ou o exílio. Este impulso de colonização revela a crise institucional e simultaneamente testa a força das instituições, denotando também uma crise social, ambas a indicar que, aqui, a pandemia se espraia em meio ao pandemônio.
Este artigo tem por objetivo investigar a filiação filosófica dos denominados direitos da natureza. A questão central deste texto é saber se é procedente afirmar que a concepção da natureza enquanto titular de direitos significa rompimento com a ética Antropocêntrica e, entre as correntes da ética Ambiental, qual delas está alinhada com tal perspectiva. Apesar de ser comum a tese de que os direitos da natureza denotam uma posição biocêntrica, este artigo conclui que a posição filosófica que realmente identifica esta formulação é a da ética Ecocêntrica, o que não significa, a rigor, afastamento ou superação do antropocentrismo. investigam-se autores referenciais para a problemática, bem como a legislação constitucional do Equador e da Bolívia. indaga-se também a fundamentação que justificaria reconhecer direitos à natureza, mas não reconhecer direitos aos animais. A metodologia adotada implica análise da bibliografia basilar acerca do tema, que é basicamente de origem estrangeira: europeia, estadunidense e sul-americana. A importância do tema está no exame jusfilosófico da virada paradigmática proposta pela ética Ambiental, notadamente pela ética Animal. Atribuir direitos à natureza significa rever essencialmente os critérios tradicionalmente empregados pelo Direito para o reconhecimento de direitos subjetivos.
