AbstrakTujuan penelitian ini adalah untuk mengetahui perkembangan kebijakan subsidi di bidang perumahan di Indonesia, dan untuk mengetahui kendala-kendala yang menghambat pembangunan perumahan bersubsidi di Indonesia. Penelitian ini merupakan penelitian hukum normatif, yaitu penelitian yang dilakukan dengan cara meneliti data sekunder (pustaka) terdiri dari :bahan hukum primer; bahan hukum sekunder. Dalam penelitian hukum normatif, data yang telah terkumpul, baik melalui inventarisasi bahan-bahan hukum primer maupun penyelusuran bahan sekunder, dilakukan content analysis yang kemudian diolah menjadi premis-premis umum tentang norma-norma umum dalam peraturan subsidi di bidang perumahan.Selanjutnya dianalisis secara deduktif dengan mempergunakan pola berfikir silogisme yang tersusun dari dua buah pernyataan (premis mayor dan premis minor) dan sebuah kesimpulan. Kesimpulan:1)pemberian subsidi terhadap masyarakat berpenghasilan rendah ini diharapkan akan mewujudkan masyarakat khususnya masyarakat berpenghasilan rendah untuk memiliki rumah; 2) rendahnya tingkat serapan terhadap perumahan bersubsidi. Surakarta occupies the entire administrative territory with an area of approximately 4,672 hectares. In the national development strategy and policy of the Provincial Government of Central Java, Surakarta completes its function as a tourism city. The existence of several cultural events held in Surakarta such as the Solo Batik Carnival is a special attraction for tourists. Apart from that, Surakarta is also known as a cultural city with tourism potential such as the palace and the presence of small and medium industries (SMI) whose products attract tourists. This study aims to determine the potential of existing SMI products as a tourist attraction and encourage tourism potential in the city of Surakarta. This study uses qualitative methods by observing, reviewing data, and making observations. The results of the study show six SMI Innovative Business sectors which are a priority to be built, developed, and managed in Surakarta, namely fashion, visual communication design, craft, culinary, performing arts, and visual. The leading SMI Innovative Business Centers are relatively spread across five sub-districts in Surakarta City, namely Jebres, Banjarsari, Laweyan, Pasar Kliwon, and Serengan. SMI centers developed to encourage tourism potential and advance the economy in Surakarta City. SMI also cooperates with cooperatives in providing access to capital and product marketing.
Belakangan ini telah terjadi kasus pidana perbankan terhadap pelanggaran penerapan prinsip kehati-hatian. Penelitian ini bertujuan untuk mengidentifikasikan pertanggung jawaban hukum terhadap tindak pidana perbankan menurut Undang-undang Nomor 10 Tahun 1998. Jenis penelitian yang dilakukan adalah penelitian hukum dengan Yuridis Normatif dengan melakukan pengkajian pertanggungjawaban pidana dalam kejahatan perbankan. Metode pengumpulan data yang digunakan adalah Metode Kepustakaan dan metode pendekatan kasus (case approach). Hasip penelitian ditemukan bahwa, Bentuk pertanggungjawaban yang berlaku pada tindak pidana usaha bank adalah sama dengan konsep pertanggungjawaban pada tindak pidana yakni pengurus dan/atau korporasi berbuat, pengurus bertanggungjawab. Korporasi sebagai badan hukum yang bukan berbentuk recht person tidak dapat menjalankan hukuman pidana berupa kurungan badan. Korporasi hanya mungkin menjalankan putusan pengadilan sepanjang yang berkaitan dengan penggantian kerugian ataupun apabila eksistensi/ izin usahanya dicabut. Namun dalam putusan pengadilan atas kasus tindak pidana korupsi, hukuman pidana berupa denda maupun kurungan badan pada umumnya merupakan satu kesatuan. Dalam hal ini, ketentuan pidana yang ada dalam Undang-Undang Perbankan tidak langsung diterapkan apabila terjadi tindak pidana. Bahwa ketentuan pidana dalam Undang-Undang Perbankan bersifat ultimum remedium, penerapan ketentuan pidana dilakukan setelah berbagai upaya administrasi dilakukan terlebih dahulu.
The home ownership loans are one type of credit service provided by banks to customers who want special loans to meet the needs of home ownership. Credit disbursement by banks must be carried out with the principle of prudence (prudential banking), and must go through a careful analysis of the 5C's of Credit aspects, so that the loans that will be given can be returned on time. In reality, often loans that have been distributed to debtors become non-performing loans. This study discusses the implementation of the precautionary principle and the problems faced by banks in providing subsidized mortgages. This type of research is a normative juridical research with data sources from primary, secondary and tertiary legal materials. Using literature study as a collection technique. The results of this study explain that in implementing the prudential principle of banking in providing subsidized mortgage loans, the 5C's of Credit aspects are used. And in its implementation it uses Act No. 7 of 1992. There are obstacles in the implementation of the precautionary principle, starting from the various aspects of the character of the debtor, the uncooperativeness of the debtor and the mortgage house itself whose facilities are incomplete, causing a lack of interest from the public and the lack of socialization of the minimum period of use of subsidized housing.
