A nova lei brasileira de acesso à informação estabeleceu um conjunto de definições, princípios e diretrizes voltado à promoção da transparência e à viabilização do exercício do controle social sobre a ação governamental. Segundo esta lei, os resultados dos programas do Plano Plurianual (PPA) fazem parte do conjunto de informações que precisam ser franqueadas aos cidadãos. Tais resultados são gerados a partir das regras da sistemática de monitoramento e avaliação de programas que deve ser estabelecida no próprio PPA. Este trabalho objetiva analisar a aderência desta sistemática à lei de acesso à informação, com a finalidade de suscitar o debate sobre a existência de certas opacidades que podem restringir o acompanhamento e a avaliação da ação governamental pela sociedade.Palavras-chave: acesso à informação, transparência governamental, controle social, monitoramento, avaliação de programas
O objetivo deste trabalho é examinar se a aplicação dada pela Prefeitura de Macaé aos royalties que aquele município recebeu pela exploração e produção de petróleo e gás natural (E&P) da área de pós-sal até eclosão da crise iniciada em 2014 teria sido coerente com a finalidade social daquela compensação financeira. Tendo que a finalidade deste instituto seria propiciar um desenvolvimento sustentável das áreas onde ocorra a exploração e a produção de petróleo e gás natural, mesmo após o esgotamento das bacias, pergunta-se: mas para que vêm servindo mesmo os royalties? Responde-se a esta pergunta a partir de pesquisa ao conjunto de registros relativos à aplicação dada pela Prefeitura de Macaé aos recursos oriundos dos royalties do pós-sal, relacionados à rubrica “royalties 5% da lei 7990”, disponíveis por meio do portal da transparência (PTM) daquele município Os resultados obtidos indicam que aquela prefeitura, entre 2012 e 2014, aplicou quase três quartos dos recursos dos royalties do pós-sal de forma, a princípio, imprópria frente a sua finalidade social. Como se tratam de recursos voltados para o financiamento do desenvolvimento sustentável, defende-se a promoção de debate sobre a melhoria das instituições relacionadas aos royalties, que visem estabelecer programas de sua aplicação, e não simples previsões de vinculações, como já existe para saúde e educação.
A reforma do Estado no Brasil, em particular no plano da administração pública, tem se apresentado como um projeto inesgotável, tendente a se repetir como panacéia a cada governo. Às vésperas de uma nova reforma administrativa, anunciada pelo atual governo brasileiro, recupera-se nesse artigo a discussão inacabada sobre a última grande reforma ocorrida na década de 1990. O objetivo é expor as impressões sobre a reforma ocorrida e em particular sobre o exercício da cidadania, passados na ocasião da pesquisa, mais de dez anos das mudanças que pretendiam submeter o aparelho público ao interesse do cidadão. Para realizar o estudo, além da pesquisa bibliográfica, realizou-se uma pesquisa de campo - a aplicação de survey a um público qualificado, pós-graduandos da Universidade Federal Fluminense - com o intuito de mensurar o grau de adesão ao discurso da reforma gerencialista e verificar em que dimensão esse público tem exercido efetivamente a sua participação-cidadã. Como resultado, observou-se que os maiores índices de participação foram aqueles relacionados à esfera do consumo e à reivindicação dos direitos individuais. A preocupação e o dever de ser cidadão foram reduzidos à condição de consumidor.
