La implementación de los Protocolos de Protección a Migrantes (MPP), conocido en México como el programa “Quédate en México”, fue una acción del gobierno de Estados Unidos mediante la cual ciertas personas extranjeras que ingresaban o buscaban admisión a dicho país desde México, de forma iregular, podían ser devueltas a este país para esperar la resolución a su solicitud de admisión (asilo). El gobierno de México convino, por razones humanitarias, recibirlos y permitir una estadía en el país durante la vigencia del trámite migratorio legal. Esta situación de reasentamiento convirtió a México en un supuesto “tercer país seguro”, un hecho que de entrada no considera el largo expediente de violaciones de derechos humanos hacia los migrantes en tránsito por territorio mexicano, por consecuencia el presente trabajo presenta una reconceptualización de la migración forzada a raíz de este tipo de acuerdos
Este trabajo explora elementos de vulnerabilidad económica presentados por un sector industrial de Baja California durante la primera ola del COVID-19 en México. Para tal objetivo, se aplica el modelo de Presión y Liberación (PAR) mediante el cual se analiza la información obtenida a través de un panel de representantes del sector empresarial. Los resultados permiten identificar procesos y factores que explican la fragilidad (vulnerabilidad) del sector industrial ante eventos adversos como la pandemia de COVID-19.
El presente artículo presenta, a través de la prueba de proporcionalidad, un análisis con relación al último párrafo del artículo 32 constitucional y la discrepancia de éste con el derecho de igualdad y no discriminación contenido tanto en la Constitución como en los distintos tratados internacionales en materia de derechos humanos de los cuales el Estado mexicano es parte. Lo anterior es así pues este párrafo manifiesta una preferencia del mexicano frente al extranjero, en igualdad de circunstancias para toda clase de empleos, cargos o comisiones de gobierno en los que la calidad de ciudadano no es indispensable. Lo anterior no quiere decir que los Estados no puedan hacer distinciones entre sus connacionales y los extranjeros bajo su jurisdicción, sin embargo, estas distinciones —o restricciones— deben de estar justificadas, de lo contrario, se tornaría en una medida arbitraria y, por consiguiente, discriminatoria.
