Neste artigo são abordadas as políticas públicas infantojuvenis brasileiras com foco nos Conselhos Tutelares de Novo Hamburgo, Região 1 e 2. Essa escolha deve-se ao fato de o conselho tutelar ser uma das principais instituições criadas pelo Estatuto da Criança e do Adolescente (ECA). Com base na questão “Como se efetivam as políticas públicas para crianças e jovens nos Conselhos Tutelares selecionados?”, objetiva-se desvendar a relação entre as políticas públicas e o ECA, apontar o que são conselhos tutelares e analisar como os Conselhos Tutelares de Novo Hamburgo discutem as políticas públicas no cotidiano e como se relacionam com as demais instituições responsáveis por implementar políticas públicas para a área infantojuvenil. Parte-se de uma revisão da literatura, de um exercício etnográfico realizado na sede dos dois Conselhos Tutelares no município escolhido e de entrevistas não diretivas com conselheiras. Nessas vivências, as políticas públicas são entendidas como fundamentais para a ação dos Conselhos, mas não se revestem da força necessária para garantir os direitos estipulados pelo ECA.
O Estatuto da Criança e do Adolescente é central quando falamos em políticas públicas infantojuvenis brasileiras e um de seus pontos é a criação de conselhos tutelares. Neste estudo, a questão principal é: como as políticas públicas são operacionalizadas pelo cotidiano do Conselho Tutelar de Novo Hamburgo Região 1 e no Região 2? Para tanto, realizou-se uma revisão narrativa da literatura e fez-se um exercício etnográfico na sede dos Conselhos Tutelares de Novo Hamburgo durante um período de massivo impacto da COVID-19.
Este artigo tem como tema os direitos das infâncias e juventudes brasileiras no contexto da redemocratização e promulgação do Estatuto da Criança e do Adolescente (ECA) em 1990, o qual, dentre outras questões, aponta para a criação de um conselho tutelar em cada cidade do Brasil. Partimos das seguintes perguntas: como se deu o processo de criação do Conselho Tutelar de Novo Hamburgo no início dos anos 1990? E como este influenciou na busca pelos direitos infantojuvenis do município? Os objetivos são, abordar, brevemente, o ECA, analisar o processo de implementação do Conselho Tutelar de Novo Hamburgo e atentar para como esta instituição atuou para a garantia dos direitos infantojuvenis durante sua primeira gestão (1992-1995). Partimos de uma revisão narrativa da bibliografia acerca das temáticas aqui tratadas, da análise de entrevistas não-diretivas com conselheiras tutelares do período e da análise de ofícios e livros de atas do Conselho. Ao final do texto, apontamos para a importância da criação dos conselhos tutelares, espaços que se tornaram referência na proteção dos direitos infantojuvenis e que são a “ponta do atendimento” a estes sujeitos. Porém, o processo de instauração do Conselho de Novo Hamburgo foi cercado de tensões envolvendo prefeitura, entidades de atendimento infantojuvenil e comunidade. Até hoje são latentes as disputas em torno dos direitos das infâncias e juventudes.
O presente estudo pretende analisar as bases teóricas adotadas para tratar da noção de infância e de adolescência e como os direitos destes se instituem na América Latina, a partir da perspectiva colonial e decolonial. Com base em estudos bibliográficos, aponta-se o que é a colonialidade e o que são estudos decoloniais; aborda-se a construção da noção de infância e adolescência na Europa e como essa foi trazida à América Latina; analisa-se a construção dos direitos das crianças e adolescentes, principalmente a partir da ONU e do UNICEF, e como isso transferiu-se para a América Latina, em especial ao Brasil. As análises realizadas evidenciam que a construção europeia da noção de infância e adolescência e de seus direitos foi levada à América Latina e se mantém através, principalmente, da colonialidade do poder, do ser, do corpo e do saber implicando em uma formulação e padronização dos sujeitos aos moldes eurocêntricos.
