O artigo tem por objetivo discutir a noção constitucional de terra tradicionalmente ocupada, a partir dos fundamentos jurídicos, antropológicos e indígenas em que se ancoram os processos de demarcação de terras indígenas, explorando os limites das intepretações recentes em torno do conceito.
This thesis is an ethnography of the law's production systems on the Brazilian Supreme Court. The idea is to trace these productions from its invention and files circulation, the decision techniques e the intervention spaces of the ministers, assessors and law analytics. I then analyze the court's internal relations, highlighting the documents and documentation process, the procedures and the temporality on the processing fluxes' of an action. Throughout the processing it seeks to capture the legal forms' agency and the relation between people, causes and process, from the court sections work routine where the files are produced and circulate. point the possibility of interference of political interests external to law, the goal of this article is to reflect on the ways that politics are made in the realm of law on the basis of a concept of legal practice seized in the composition of the court, the management of processes and the relationships between ministers and their offices. In this sense, decisions, relationships and processes are taken as objects that modulate the direction of truth and establish the possibilities of transformation.
"Essa é uma obra de ficção, qualquer semelhança com a realidade é mera coincidência".A frase acima não tem um autor identificado; geralmente, é a última frase que aparece nos cré-ditos de filmes, novelas ou seriados. Funciona para eximir as histórias contadas de qualquer responsabilidade legal diante dos fatos e personagens reais que possam servir de inspiração ao roteiro. Não obstante, a advertência poderia terminar também um processo judicial, com efeito inverso, justamente afirmando a reponsabilidade legal das narrativas dos processos, como forma que garante que seu contexto é a técnica jurídica. É sobre a técnica e ficção que esse artigo se concentra, tentando capturar as formas como se produz uma decisão jurídica no Supremo Tribunal Federal -lugar em que realizei pesquisa de campo. A ideia de ficção que pretendo evocar nesse artigo tem justamente um sentido entendido pelos operadores como técnico, como aquilo que permite determinadas analogia, determinadas transformações que nos termos de Yan Thomas (2011:12) possibilitam uma alteração dos fatos na passagem do mundo do ser para o mundo do dever ser. Na realidade, talvez se possa-dizer que esse artigo é sobre analogia, ou sobre o papel das analogias nessas passagem e nessas transformação; as analogias jurídicas e as minhas próprias analogias tentando compreendê-las.Há muito se discute o caráter ficcional de qualquer produção científica, incluindo o próprio campo da produção etnográfica. Marylin Strathern, por exemplo, ao discutir o trabalho do antropó-logo James Frazer, a certa altura afirma que um escritor quando escolhe o estilo científico ou literário, assinala o tipo de ficção que faz, "não se pode fazer a escolha de evitar completamente a ficção" (Strathern 1987: 276) Contudo, a ideia de ficção que me parece operar nesses casos, pelo menos em grande parte deles -quando não se trata de uma posição de denúncia -não altera qualquer status de verdade ou realidade da produção -mesmo porque ele é o que menos importa, tendo em vista que são os efeitos dessas ficções que ganham maior relevo. Ainda que não me caiba aqui discutir o caráter ficcional da produção
Esse artigo toma o renovado interesse dos antropólogos na teoria da propriedade como uma oportunidade para considerar a teoria e prática do direito como um tema etnográfico. Meu foco está em um constructo particular – o instrumento, ou as relações de meios para fins que animam tanto a teoria jurídica quanto a antropológica sobre proprie- dade.Uma análise da produção desse constructo leva-nos à conclusão deque menos do que uma crítica dos fins do conhecimento jurídico, a antropologia da propriedade deveria se dedicar a articular seus próprios meios.
