Los derechos de los pueblos indígenas han adquirido una protección multinivel bajo el entendido de que tanto el Sistema Interamericano de Derechos Humanos (SIDH) como el derecho interno del Estado colombiano contemplan garantías a sus derechos. El bloque de constitucionalidad, al estar integrado por la Convención Americana de Derechos Humanos (CADH), requiere que la normatividad interna no contravenga las disposiciones de la Convención. Al respecto, la Corte Constitucional de Colombia ha avanzado en el reconocimiento de derechos tanto individuales como colectivos para los pueblos indígenas en Colombia, reconocimiento que, pese a ser de gran importancia, resulta insuficiente porque persisten graves violaciones de los derechos humanos de estos sujetos de especial protección.
El artículo tiene por objetivo identifcar si la Sala Civil de la Corte Suprema de Justicia de Colombia ha ejercido un control de convencionalidad en situaciones que involucran el derecho a la familia. El resultado se consigue mediante el desarrollo de una investigación descriptiva, cualitativa, básica y jurídica, que utiliza el método analítico deductivo e inductivo, y centra su análisis en las disposiciones de la Corte IDH y en las sentencias emitidas por la Sala Civil de la CSJ durante los años 2005 a 2017. Se observa que la CSJ ha ejercido de forma expresa la fgura del control de convencionalidad en diferentes situaciones que involucran el derecho a la familia, por lo cual en el presente artículo se analizarán dos de ellas: i) cuando existen hechos relacionados con violencia intrafamiliar y ii) cuando existen hechos que afectan los derechos de los menores como el derecho a recibir alimentos, a la nacionalidad, a la personalidad jurídica y el derecho a no ser separado de su familia o de alguno de sus padres.
