The protection of cultural heritage from illicit trade is today a global imperative, and the return of unlawfully removed cultural goods is essential to enforce cultural rights. Indeed, every community has the right to enjoy its cultural heritage and keep alive its collective memory. While referring to these general objectives of contemporary international cultural heritage law and policy, this article seeks to explore those instruments of the Brazilian national legislation that could be effectively applied to combat the illicit trafficking of cultural goods. To this end, it first outlines the relationship between Brazil’s international law obligations and its national legislation in respect of cultural heritage. In other words, it explains how these obligations have been implemented in the national legal system and to what extent they have affected actual regulatory solutions. Next this article identifies and debates, through hermeneutic analysis, those legal provisions and instruments of the Brazilian law which could be used to prevent the illicit transfer of cultural goods. It also recalls the Banco Santos case, which provides a clear example of the shortcomings and pitfalls of the current legal system for the protection of cultural heritage in Brazil. Finally, this article advocates mediation as an alternative method of cultural heritage-related dispute settlement, particularly regarding cases of illicit trade.
Este artigo discute duas estratégias acerca da proteção do patrimôniocultural arqueológico brasileiro: o turismo, como fonte de acesso e valorização do patrimônio cultural, e o direito, com a efetividade normativa concernente a proteger o patrimônio cultural, por conta de seu valor quanto a memória e identidade de uma comunidade. Assim, a ausência de organização das atividades turísticas e as práticas ilícitas, como o tráfico ilícito e o comércio ilegal de bens culturais, podem ser consideradas algumas das responsáveis pela deterioração e dilapidação desses bens, como é observado com o patrimônio arqueológico tapajônico de Santarém – Pará. A pesquisa foi descritiva exploratória, identificando que a efetiva aplicação da legislação e a organização das atividades de visitação poderiam ser estratégiaspara a preservação e a manutenção do patrimônio cultural brasileiro, principalmente do arqueológico.Palavras-chave: patrimônio arqueológico; turismo; direito; estratégias depreservação.
The illicit trafficking of cultural property is a reality in most South American countries. For years, although cultural diplomacy has evolved in the national and multilateral spheres, no significant concrete measures have been taken to fight the illicit trafficking, which has kept developing even after the 1970 UNESCO Convention. In that context, two recent initiatives seem to promote new perspectives. The Mercosur-Unasur Technical Committee for the Prevention and Fighting of Illicit Trafficking of Cultural Property establishes a multilateral dialogue in the field, fostering respect and promotion of the cultural diversity in the region. The Brazilian National Committee for the Fighting of Illicit Trafficking of Cultural Property, which still has not been institutionalized, intends to be a discussion venue in the field, establishing a multi-stakeholder approach in the national level. The main challenges that will be faced by both committees concern the implementation of concrete measures within South American source countries, as well as possibly exercising pressure to induce market-end states to adopt the necessary reforms to fight the illicit trafficking of cultural property.KEYWORDS: Cultural diplomacy; Mercosur; Unasur; illicit trafficking of cultural property.RESUMOO tráfico ilícito de bens culturais é uma realidade na maioria dos países sul-americanos. Durante anos, embora a diplomacia cultural tenha progredido nas esferas nacional e multilateral, não foram tomadas medidas concretas significativas para combater o tráfico ilícito, o qual continuou se desenvolvendo mesmo após a Convenção da UNESCO de 1970. Nesse contexto, duas iniciativas recentes parecem promover novas perspectivas. O Comitê Técnico para a Prevenção e o Combate ao Tráfico Ilícito de Bens Culturais do Mercosul-Unasul estabelece um diálogo multilateral sobre o tema, impulsionando o respeito e a promoção da diversidade cultural na região. O Comitê Nacional de Combate ao Tráfico Ilícito de Bens Culturais, que ainda não foi institucionalizado, pretende ser um foro de discussão sobre o tema, estabelecendo uma abordagem a partir da participação de diversos atores em nível brasileiro. Os principais desafios que ambos os comitês terão de enfrentar consistem na implementação de medidas concretas nos países de origem sul-americanos, bem como possivelmente o exercício de pressão para induzir países destinatários do mercado final de bens culturais a adotar as reformas necessárias para combater o tráfico ilícito de bens culturais.PALAVRAS-CHAVE: Diplomacia cultural; Mercosul; Unasul; tráfico ilícito de bens culturais.
Al patrimonio cultural se les asignan valores históricos y culturales para una determinada nación. Debe considerarse que muchos de estos bienes son identidad y memoria de la historia y de la cultura de toda la humanidad. La destrucción intencional y directa de un patrimonio cultural en determinado territorio en tiempo de guerra es crimen de guerra y debe ser tratado como tal por el Derecho Humanitario. El artículo analiza el caso de Timbuktu, en el que la destrucción de patrimonio cultural fue considerada crimen de guerra. Se presenta, una breve historia sobre la protección del patrimonio cultural en tiempos de guerra, así como la normativa vigente, entre ellas, la Resolución 2347 del Consejo de Seguridad de las Naciones Unidas, siendo la primera resolución dirigida únicamente a la protección del patrimonio cultural en caso de conflicto armado. Por último, se aborda la primera condena de crimen de guerra por la Corte Penal Internacional de destrucción directa de patrimonio cultural, ocurrida en Malí.
