The Portuguese judicial system has attracted considerable criticism in recent years and demands for reforms have gained prominence. By using the Data Envelopment Analysis technique and focusing on the performance of 223 Portuguese first instance courts during the period of 2007 to 2011, this research has found evidence that supports some of this criticism and justifies the calls for reforms, better performance and accountability of the judicial system. In particular, our results found a sector with considerable scope for improvement with less than 16 percent of the 223 courts analysed making an efficient use of their resources in each year and with only one third of the courts being considered efficient in at least one of the five years assessed. Whilst the results suggest that improvement can be achieved with better case management, scale factors also seem to play an important role in explaining inefficiency, with most of the inefficient courts being smaller than optimal and with smaller courts being, on average, less efficient than larger ones. The existence of a statistically significant relationship between courts' efficiency and size was confirmed by the Mann-Whitney test. These results indicate considerable scope for improvement and that some of the planned reforms are timely and seem well targeted. However, the results also suggest that efficiency increases matching peers' best practices are not enough to sustainably reduce the prevailing judicial backlog and length of court proceedings in a considerable number of courts. Major changes in the capacity and/or functioning of the Portuguese judicial system might also be required.

RESUMOEste artigo buscou mapear decisões de gestores de redes de franquias de forma a compreender qual tem sido a sistemática da escolha dos franqueadores em termos de características, e quais as métricas adotadas para mensurar o desempenho. Por meio de entrevistas com 15 franqueadores brasileiros confirmou-se que a receita é a principal métrica utilizada pelas franquias nacionais para medir desempenho, embora indicadores outros também sejam utilizados de forma complementar. Dois outros fatores foram citados pelos entrevistados como influenciadores da avaliação do desempenho: o subinvestimento alinhado à presença, e o relacionamento, influenciado pelo tempo de rede.Palavras-chave: Franquias brasileiras; Franqueados; Parceiros de negócios; Tomada de decisão; Franchising. ABSTRACTThe article searches to map the manager's decisions in order to understand what has been the franchisor system for choose regarding to characteristics, and what the metrics has been adopted to measure the performance Though 15 interviews with Brazilian franchise there was confirmation that revenue is the main metric used by national franchises to measure performance, although other indicators are also used in a complementary way. In addition, two other factors were cited by the interviewees as relevant during the performance evaluation: the underinvestment aligned to the presence, and the relationship, influenced by the network time. RESUMENEste trabajo buscó el mapeo de las decisiones de gestores de redes de franquicias para comprender cuál ha sido la sistemática de elección de los franquiciadores en términos de sus características y cuáles las métricas adoptadas para medir el desempeño. A través de entrevistas con 15 franquiciadores brasileños se confirmó que los ingresos son la principal métrica utilizada por las franquicias nacionales para medir desempeño, aunque otros indicadores también se utilizan de forma complementaria. Dos otros factores fueron citados por los entrevistados como influyentes de la evaluación del desempeño: la subinversión alineada a la presencia, y la relación, influenciada por el tiempo de red.

Towards Franchising Mobilization Strategy in Large-Scale Energy Efficiency Retrofit Industry

Implementing large-scale energy retrofit projects for reducing residential energy consumption requires large scale mobilization and training of contractors with the appropriate skill sets for carrying out the retrofits. General contractors, one of the key parties in these types of projects, play a crucial role in facing the challenge of large-scale, national level mobilization. Most retrofit projects are performed in a fragmented manner, that is, a small percentage of contractors undertake executing all the retrofit tasks, and other contractors, typically trade subcontractors, prefer to operate only in their specific fields of proficiency. In addition, most general contractors operate in very geographically specific markets, limiting their market share and access. We propose a transition step in the conduct of energy efficiency retrofits by adopting a franchising business model as a leveraging strategy for general contractors in the retrofit industry. This study is being carried out to investigate the conceptual and practical benefits of franchising a mobilization option for large-scale energy retrofit industry. Based on the nature of this industry, a practical franchising arrangement is also proposed for this sector.
